From and after the final passage, approval and publication, as required by law, of this article, the number of licenses to sell alcoholic beverages in the Borough of Pine Beach, Ocean County, New Jersey, at retail shall be limited as follows: Not more than two plenary retail consumption licenses, not more than one plenary retail distribution license and not more than one club license shall be in effect and outstanding at any time.

A. 
No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage or allow the consumption of any alcoholic beverage on licensed premises between the hours of 2:00 a.m. and 7:00 a.m.

C. 
Licensees are authorized to sell wine and malt alcoholic beverages in original bottle or can containers for consumption off the premises on the same days and during the same hours as the sale of alcoholic beverages for consumption on the premises is permitted as set forth above. Licensees are authorized to sell distilled spirits in original bottles or containers for consumption off the premises during the hours of 9:00 a.m. to 10:00 p.m. daily, including Sundays.
D. 
The sale by licensees of distilled spirits, wine or malt alcoholic beverage for consumption on or off the licensed premises other than during the hours stated above is prohibited.
E. 
The hours hereinabove referred to shall be Eastern standard time, except when Eastern daylight saving time shall be in effect in the borough.[1]

No alcoholic beverage shall be sold, delivered or served nor shall the sale, delivery or serving of any alcoholic beverage be permitted or suffered upon any licensed premises in the Borough of Pine Beach during any period of time when the sale thereof is prohibited by the terms of this article or by law.
Each and every license for the sale of any alcoholic beverage shall be issued subject to statutory provisions and the rules and regulations of the Director of the Division of Alcoholic Beverage Control and also subject to any and all rules and regulations at any time adopted by the governing body of this municipality.

Beginning September 1, 2005, the annual license fees for licenses in this municipality shall be and are hereby fixed as follows:
A. 
Plenary retail consumption license:
2006: $2,400
2007: $2,500
B. 
Plenary retail distribution license: $2,500.
C. 
Club license: $150.
Violation of Title 33 of the Revised Statutes of New Jersey or of the regulations promulgated by the Director pursuant thereto or of this article shall be cause for the suspension or revocation of any license hereinbefore referred to.
