The purpose of this chapter is to regulate the parking or storage
of commercial vehicles with a Gross Vehicle Weight (GVW) over 16,000
pounds on residential lots or streets within the Borough of Pine Beach.
Residential lot is defined in Section 175-6 of the code as a designated parcel, tract or area of land established by a plat or otherwise as permitted by law and to be used, developed or built upon as a unit.
It shall be unlawful to park or store any commercial vehicle
with a GVW over 16,000 pounds on any residential lot or street within
the Borough of Pine Beach. Smaller commercial vehicles shall be permitted
on driveways of residential lots and limited to one commercial vehicle
per home.
Any person violating the provisions of this chapter shall be
subject to a fine not to exceed $500 or up to 30 days incarceration
or both. Each day that a violation exists shall constitute a separate
violation and a separate penalty may be imposed for each violation.
A motor vehicle which is parked in violation of this chapter
within the Borough of Pine Beach may be removed from the residential
lot or street by the Borough of Pine Beach or its agents. The cost
of removal shall be paid to the borough or its agents by the owner
at such time as the owner shall claim the vehicle.
