A. 
No person shall use any of the boat slips located at the base of Avon Road or docks or the Windy Cove boat launching ramp in the Borough of Pine Beach without having first paid for and obtained a permit for the use thereof. The ramp permit shall be displayed on the trailer post on all trailers parked in the municipal parking lots.
B. 
The Municipal Clerk or such assistant as may be designated by the Municipal Clerk is hereby designated as the person to represent the Governing Body granting any permit or rental agreement for the use of Borough boating facilities.
A. 
The Municipal Clerk shall issue boat slip rental permits and boat launching ramp permits to any person upon the payment by such person to the Municipal Clerk of the fees hereinafter provided.
B. 
Along with the fee, boat slip renters must file the proper application showing the name and address of the applicant, the size, type and registration number of each boat to be licensed, a hold harmless agreement and provide proof of boat insurance with the Municipal Clerk.
A. 
The fee to be charged for the rental of the Borough slips or docks shall be as follows:
(1) 
2023 Season: $900.
(2) 
2024 and each succeeding year an increase of $50 per season unless otherwise changed by resolution of the Governing Body.
(3) 
The seasonal lease shall include a parking permit and two one day ramp permits. Boat slips or docks shall not be subleased or transferred.
B. 
The fee to be charged for use of the boat launching ramp effective January 1, 2023 shall be as follows:
(1) 
Personal use: Yearly permit $150 per year if purchased prior to April 15 and $175 if purchased after April 15.
(2) 
Commercial use: Yearly permit effective January 1, 2023: $1,500.
(3) 
Daily ramp fee effective January 1, 2023: $40 per day (includes parking and ramp use).
(4) 
In the event that any power boat racing organization, or other boating organization should seek to conduct a special event utilizing the Borough's boat ramp or other facilities, it shall be required to make application for the same to the Borough Council, which shall set the fees to be charged based upon the nature and extent of the facilities to be utilized.
C. 
Any person who intends to or does use a launching ramp in connection with a marina boat sale, boat repair or other business purposes shall be charged the commercial rate.
A. 
Use of boat slips and docks shall be restricted to the season beginning April 1 and ending November 30 of each year, provided their insurance coverage is in effect.
B. 
All boats must be removed from the boat slip or dock by November 30. A penalty fee of $25 per day will be charged if a boat is kept in the boat slip or dock after November 30.
C. 
Any small boats stored on the approved areas of the beach must be removed by November 30.
D. 
Boat slip rentals shall be restricted to owners of homes located with the Borough of Pine Beach until such time as the waiting list consisting of owners of homes within the Borough is exhausted. When the aforementioned waiting list is exhausted, boat slips shall be offered to individuals not meeting the description provided above on a first-come, first-served basis with the specific understanding that said individuals shall have no guaranteed right of renewal the following year in the event additional property owners in the Borough of Pine Beach place their name on the waiting list. Under no circumstances is more than one boat slip to be rented to a single residential address or nonresidential address should the residential address become exhausted.
E. 
All persons using the Municipal Boat launching ramp or Municipal slips shall do so at their own risk, and the Borough assumes no responsibility for theft, loss or damage to any boats or motor vehicles or any equipment used in connection with them.
Full payment of the boat slip fee must be received by the Borough of Pine Beach no later than April 1 of each year. Failure to pay the full boat slip rental fee by the due date will result in an immediate forfeiture of slip privileges.
Any person violating any of the provisions of this article shall, upon conviction, be subject to one or more of the following: A fine not to exceed $1,000, imprisonment for a term not to exceed 90 days or community service for a period not to exceed 90 days for each day that such violation shall occur.
