There is hereby established in the Borough of Pine Beach a chapter providing for the issuance of certificates of housing inspection for inspection of existing buildings, both resale and rental; establishing fees therefor and providing for penalties for violations thereof.
No person or persons, firm, partnership, entity or corporation shall rent or lease or allow any other person or persons, firm, partnership, entity or corporation to live in or inhabit as a tenant, or use any apartment house, home, dwelling or commercial business establishment in this borough, unless said person or persons, firm, partnership, entity or corporation shall have first obtained a permit from the Borough of Pine Beach to do so.

No person or persons, firm, partnership, entity or corporation in the Borough of Pine Beach purchasing any resale home, dwelling or commercial establishment shall occupy any such building or premises or allow any portion of such building or premises to be occupied in any manner without first obtaining a certificate of housing inspection from the Borough of Pine Beach. The application shall include such additional information as the Borough may require in order to administer the provisions of this section.

A. 
A fee of $75 for the inspection for a dwelling, or $75 per unit for multiple-use dwellings shall be assessed for the issuance of each such permit and such permits shall be issued upon completion of an inspection of the building or premises by the Zoning Officer or designated agent.
B. 
A fee of $40 per single-family dwelling or $40 per unit for multiple-use dwellings shall be assessed for one reinspection.
C. 
In the event the premises fail the reinspection all subsequent inspections will cost $75 per single-family dwelling or $75 per unit for multiple-use dwellings.
All rental homes or apartments shall be inspected before new tenants shall be permitted to move in.
A. 
The title shall be 64-6. Smoke Alarms for one-and two-family dwellings; carbon monoxide alarms; and portable fire extinguishers required.
B. 
No certificate of housing inspection permit for any building or dwelling shall be issued unless and until the requirements of N.J.A.C. 5:70-4.19 regarding smoke alarms, carbon monoxide alarms and portable fire extinguishers has been met along with compliance with any subsequent NJ Uniform Fire Code requirements.
No certificate of housing inspection shall be issued for any building or dwelling or apartment that is adjudged by the Zoning Officer, Board of Health or its designated agent to be unfit or unsafe for human habitation. A report that a building or dwelling or apartment unit is unfit or unsafe for human habitation shall be filed forthwith after the inspection with the Board of Health. The Zoning Officer or Board of Health or its designated agent shall determine that a building, dwelling or apartment unit is unfit or unsafe for human habitation if such conditions exist in such premises that are dangerous or injurious or unsafe to the health, safety or welfare of the occupants of such premises or to the residents of the Borough of Pine Beach. Such conditions may include, but are not limited to, deterioration; storage of excessive debris, waste, garbage or rubbish; infestation; lack of adequate ventilation, heat, light or sanitary conditions; disrepair or structural defects; unsafe or unfit health or cleanliness conditions; or disrepair or defects that may cause hazards or lead to unsafe or dangerous conditions.
All ordinances and resolutions or parts of ordinances and resolutions inconsistent herewith are hereby repealed as to the extent of such inconsistency.
Any person or persons, firm or corporation who shall violate any of the provisions of this chapter shall, upon conviction thereof, be subject to one or more of the following: a fine of not more than $1,000, imprisonment for a period not exceeding 90 days or community service for a period not exceeding 90 days for each and every offense.
