It shall be unlawful for any person to make or cause or suffer or permit to be caused upon any premises owned, occupied or controlled by owner, or lawful tenant, including any public place, street or thoroughfare in the Borough of Pine Beach, any unnecessary or obtrusive noises or sounds by means of the human voice or any other natural or any mechanical means. Persons shall not conduct upon such places any activity where such noises, sounds or activity may reasonably be expected to cause annoyance or be offensive to the inhabitants of the Borough of Pine Beach or be injurious to the health, peace or comfort of any of said inhabitants by reason of the prolonged, unnatural or unusual nature of said noises. The following are days and times of normal engagement:
A. 
Property owners are permitted to perform construction or landscaping work between 7:30 a.m. and Sunset on weekdays; or between 9:00 a.m. and Sunset on weekends and public holidays.
B. 
Commercial operators are permitted to provide their services between 8:00 a.m. and Sunset on weekdays or between 9:00 a.m. and Sunset on weekends and public holidays, except in the case of an emergency.
Initial complaints will be handled by the Pine Beach Police Department and/or the Borough Code Enforcement Officer in accordance with N.J.S.A. 2C:33-12 and this chapter. Violators will first be given a written warning, upon subsequent complaints a summons will be issued whereby the subject will be compelled to appear in the Municipal Court in the Borough of Pine Beach for a judicial decision. Any person who is convicted of violating any provision of this chapter shall be fined for each offense the sum of not less than $100 and not more than $1,000. Each day there is a violation of any provision of this chapter shall constitute a separate offense.
