Games of chance commonly known as bingo and raffles as provided
by the Laws of the State of New Jersey, N.J.S.A. 5:8-1 et seq. may
be conducted in the Borough of Pine Beach on any day of the week provided
that the applicant for the license to conduct such game otherwise
qualifies under the provisions of the aforementioned statutes of the
State of New Jersey, the rules and regulations of the Legalized Games
of Chance Control Commission or its successor, is in accordance with
this and the other ordinances of the Borough of Pine Beach and specifically
further provided that the organization or association conducting the
games is a charitable, religious or other organization specifically
qualifying under the provisions of the aforementioned statutes.
Any organization or association desiring to conduct a bingo
or raffle in the Borough of Pine Beach shall apply for a license permitting
such activity on a form to be provided by the Borough Clerk for such
purpose. Said application shall provide all of the information therein
or otherwise required by statute, rule, regulation or ordinance.
There shall be charged to any applicant a licensing fee which
amount shall be the greater of the following: $10 or the maximum amount
charged for such license by the Legalized Games of Chance Control
Commission; or the maximum amount chargeable by statute. The municipality
shall, however, exempt any portion of the municipal fee not necessary
to defray the cost of handling said application and licensing thereof
where the applicant is an association or organization that is nonprofit
in nature and is operated in and for the benefits of the Borough of
Pine Beach or its citizens. The Borough of Pine Beach shall also collect
such fee as may be due to the State of New Jersey, which fee shall
not be subject to any exemption.
Any license issued pursuant to the terms of this chapter shall
be valid for a period of one year from the date of issuance.
It shall be the intent and purpose of this chapter to grant
unto the Borough of Pine Beach all of the rights, privileges and responsibilities
to the maximum degree authorized and allowed pursuant to N.J.S.A.
5:8-1 et seq. and such other laws, rules and regulations as may be
adopted by the State of New Jersey for the conduct, operation, licensing
and regulation of games of chance.
Any person violating any provisions of this chapter shall upon
conviction be subject to one or more of the following: A fine not
to exceed $1,000, imprisonment for a term not to exceed 90 days, or
community service for a period not to exceed 90 days. Such violation
may be prosecuted upon conviction so penalized in addition to any
penalties provided for by the State of New Jersey.
