No single-family residential building nor any individual unit
of a multifamily residential building offered for rental or lease
shall be occupied by any tenant or lessee unless an approved and operating
smoke detector has been installed at such location or locations within
the building as shall be required by the Building Inspector or Construction
Official.
The smoke detector as required by the preceding section of this
chapter shall, when actuated, provide an alarm suitable to warn the
occupants within the building or individual units therein and shall
at all times be maintained by the owner of said building in good working
condition.
No occupancy permit for residential rentals as required by §
175-10B shall be issued for any such premises that does not comply with the requirements of this chapter, and any occupancy permit previously issued for such premises shall be revoked in the event of noncompliance with the requirements of this chapter.
Any person violating the provisions of this chapter shall, upon
conviction thereof, be subject to a fine not to exceed $100.
