There is hereby established in the Borough of Pine Beach, County
of Ocean and State of New Jersey, the position of Municipal Prosecutor.
It shall be the duty of the Municipal Prosecutor to prosecute
in Municipal Court all criminal actions, traffic violations and ordinance
violations for which a summons, complaint or notice of violation has
been issued by a police officer or other enforcement officer of the
borough.
The Borough Council shall annually determine the salary or hourly compensation for the position of Municipal Prosecutor and make necessary appropriations for payment of the same. (See Ch. 34, Salaries and Compensation.)
The Municipal Prosecutor shall be a licensed attorney of the
State of New Jersey and need not be a resident of the borough.
The Mayor shall nominate and, with the advice and consent of
Council, appoint the Municipal Prosecutor consistent with the procedures
established by N.J.S.A. 40A:60-5 and 40A:60-6. The term of office
shall be for one year and until appointment and qualification of a
successor.
