The Public Health Coordinator and legal counsel of the Ocean County Board of Health are hereby determined to be the representatives of the Borough of Pine Beach for the purpose of conducting hearings pursuant to N.J.S.A. 4:19-17 et seq., with the Public Health Coordinator to be responsible for the appointment of members of the panel who shall conduct such hearings and with the attorney for the Ocean County Board of Health to serve as legal counsel for said panel.
All costs associated with the hearing and billed by the Ocean County Board of Health to the Borough of Pine Beach shall be reimbursed to the borough by the owner of the dog. Included among those costs shall be a maximum fee of $100 to each panel member utilized in the conduct of the hearings.
The owner of a potentially dangerous dog who is found by a preponderance of the evidence to have violated the Act, (See N.J.S.A. 4:19-17 et seq., the Vicious Dog Act) or any rule or regulation adopted pursuant thereto or to have failed to comply with a panel's order shall be subject to a fine of not more than $1,000 per day of the violation, and each day's continuance of the violation shall constitute a separate and distinct violation, with the Municipal Court having jurisdiction to enforce this section. In addition, an Animal Control Officer is authorized to seize and impound any potentially dangerous dog whose owner fails to comply with the provisions of N.J.S.A. 4:19-17 et seq., or any rule or regulation adopted pursuant thereto, or a panel's order. The Municipal Court may order that the dog so seized and impounded be destroyed in an expeditious and humane manner.
The owner of any potentially dangerous dog shall obtain from the Borough of Pine Beach a potentially dangerous dog registration number and identification tag along with a municipal potentially dangerous dog license upon presentation of sufficient evidence by the owner to the Animal Control Officer that he has complied with the panel's orders. The fee for the potentially dangerous dog license and each renewal thereof shall be $700.
