(a)
The City Engineer or a designated inspector under the City Engineer's direct supervision, in conformance with §
1382.702, shall inspect all phases of the installation of the SWM BMPs as deemed appropriate by the City Engineer.
(b)
During any stage of the work, if the City Engineer determines
that the SWM BMPs are not being installed in accordance with the approved
SWM site plan, the City of Lebanon shall provide written notification
to the owner(s)/developer(s) and the contractor(s) indicating the
deficiencies and require that the deficiencies be corrected within
30 days (or longer as may be required). If the deficiencies are not
corrected within the specified period of time, the City of Lebanon
may:
(1)
Revoke any existing permits until a revised SWM site plan is
submitted and approved, as specified in this article.
(2)
Utilize financial security posted by the owner(s)/developer(s)
as part of the developer's agreement to install any unfinished
facilities or remedy any improperly constructed facilities.
(3)
Pursue other legal remedies pursuant to Division VII of this
article.
(4)
If applicable, at the completion of the project, and as a prerequisite
for the final release of the improvements guarantee, the owner/developer
or his representatives shall:
A.
Provide a certificate of final completion letter from an engineer,
landscape architect, surveyor or other qualified professional verifying
that all permanent facilities have been constructed according to the
plans and specifications and approved revisions thereto.
B.
Provide a set of as-built (record) drawings.
(5)
After receipt of the certification by the City of Lebanon, a
final inspection shall be conducted by the City Engineer or designated
representative to certify compliance with this article.

SWM BMPs should be inspected by the landowner, or the owner's
designee (including the City for dedicated and owned facilities),
according to the following list of minimum frequencies:
(a)
Annually for the first five years following construction.
(b)
Once every three years thereafter.
(c)
During or immediately after the cessation of a ten-year or greater
storm.
