The Village shall furnish such fire prevention, fire protection, emergency medical services and ambulance service to User as the Village now furnishes to any company or resident within the corporate limits of the Village of Thornton.

Such fire protection service, emergency medical service, and ambulance service is subject to prior emergency calls involving property and/or life located within the corporate limits of the Village of Thornton. However, the Village shall immediately activate its mutual aid agreements with adjoining municipalities in order to respond to any call for fire protection, emergency medical service and/or ambulance service from the User when the Village is responding to any call for fire protection, emergency medical service, or ambulance service from any resident within the corporate limits of the Village of Thornton or when the Village does not have sufficient available men and equipment to respond.

The User grants permission to the Village's Police Department to enter upon the premises of User for the protection of the Village's emergency personnel and vehicles responding to fire calls, emergency medical calls or ambulance calls originating from the residents of the property.

The User agrees to pay to the Village the applicable sum per calendar year on or before January 2 during each year that this agreement shall continue in effect. In the event that said payment is not made to the Village within 30 days after the same becomes due, the Village will consider this Agreement terminated.

The Fire Chief of the Village or his authorized representatives shall have the sole discretion as to the personnel and equipment that will respond to each fire call, emergency medical call or ambulance call provided that protection of property and/or human life will be adequate, meaning reasonable protection considering available personnel and equipment of the Village's Fire Department and contracted ambulance service.

The fire protection, emergency medical service and ambulance service shall begin upon payment of applicable fees and continue until midnight of the current contract period, unless sooner terminated as provided herein.

The Village will not be responsible for any loss or damage to any property or for any personal injury to any person caused by or resulting from acts or omissions of the Village, its officers or employees.

The Village shall be responsible for any and all insurance requirements connected with the operation of its Fire Department and contract ambulance service regarding personal injury or property damage to any person or any property which may occur while the Village's Fire Department and/or contracted ambulance service is engaged in answering a fire call, an emergency medical call or an ambulance call, working at a fire, emergency medical call or ambulance call, or returning therefrom in response to any said call from said User.
