As used in this chapter, the following terms shall have the meanings indicated:
SATELLITE EARTH STATION
Any apparatus or structure which is designed for the purpose of receiving television, radio, microwave, satellite or similar signals, in connection with what is commonly referred to as a "dish-type antenna."
The provisions of this chapter shall be administered and enforced by the Zoning Officer of the Borough of Pine Beach.
A. 
Any property owner or person or entity in possession of property shall submit to the Zoning Officer, prior to the placement of a satellite earth station, a plan showing the size of the satellite earth station, the proposed location of the same on the subject premises and such other information as may be required herein.
B. 
The Zoning Officer shall review said plan and render a decision within 20 days of the submission of said plan or within such further time as may be consented to by the property owner or person in possession of property.
The plan shall be drawn on a map to a scale not smaller than one inch equals 40 feet and not larger than one inch equals 10 feet and shall include and show the following information:
A. 
The name and address of the applicant and the owner and the name, address and the title of the person or entity preparing the plan and accompanying data, if other than the applicant, the date of preparation and the dates of each revision, where applicable.
B. 
An appropriate place for the signature of the Zoning Officer.
C. 
The lot(s) and block number of the lot(s) from the Borough Tax Map and the length of the lot lines of the subject premises.
D. 
The location and names of all existing and proposed streets abutting the lot or lots in question.
E. 
All existing buildings and structures and all accessory buildings or structures on the lot.
F. 
All existing and proposed setback dimensions and landscape areas as well as trees on the site affected by the proposed apparatus.
G. 
Existing and proposed plantings to provide screening for aesthetics.
H. 
Any and all other information necessary to meet any of the requirements of this chapter not listed above.
A. 
The diameter of satellite earth station antennas (parabolic dishes) shall not be greater than six feet.
B. 
The maximum height of the antenna and mounting structure measured vertically from the highest point of the antenna when positioned for operation shall not be greater than 10 feet above the ground.
C. 
In all zoning districts, satellite earth stations shall be installed only on the ground level.
D. 
No satellite earth station shall be closer than 25 feet from any side property line and no closer than 25 feet from any rear property line.
E. 
Satellite earth stations shall be located in the rear yard only.
F. 
Every satellite earth station shall be effectively screened by a special planting screen or fence in accordance with the regulations of the Borough Code. If used, the approved plantings shall be of such kind of proximity and density of growth as shall effectively screen the antenna and mount in all seasons of the year. All screening shall be maintained as originally approved. If the screening is not so maintained, any permit granted in connection with a satellite earth station antenna is subject to revocation by the Borough Zoning Officer.
The application for a permit to install a satellite earth station shall be $25.
Any person who violates any one or more of the provisions of this chapter shall be subject to one or more of the following: a fine of not more than $1,000, confinement in the Ocean County Jail for a period of not more than 90 days or community service for a period not to exceed 90 days for each separate offense. In the case of a continuing violation or violations, a fine of not more than $1,000 may be assessed for each day that said violation or violations are not corrected. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
