A.
The owner of every building or building site in the Borough of Pine Beach shall pay to the borough a lateral installation charge or connection fee of $600 per equivalent dwelling unit (EDU), as defined in Article III hereof, within 90 days after such sewer lateral has been installed and positioned to service such building or building site.
B.
In addition to the foregoing lateral installation charge of $600
per EDU, each building or building site owner requesting a lateral
installation at a depth lower than the depth established in the installation
specifications shall pay such additional charges as may be certified
to the Borough Clerk by the Borough Engineer for such installation
and, further, provided that topographic conditions permit such additional
depth of installation.

The required lateral installation charge shall be paid as follows:
A.
Lots with existing buildings: payment in full or on an installment
basis with a payment of $200 per EDU lateral upon application for
service, with the balance of the charge to be paid in two equal annual
installments, together with interest on the unpaid balance of 12%
per annum.
B.
Building sites with no existing buildings: payment of the lateral
installation charge in full with the application or in installments
as follows: $200 per EDU lateral upon application, and the balance
to be paid in full upon the issuance of a building permit for the
site, with all unpaid balances of principal to bear interest at the
rate of 12% per annum.
C.
In addition to the lateral installation charge or connection fee provided for above and in § 138-6 hereof, an additional fee to be determined by the Borough Engineer and certified to the Borough Clerk, but not less than $1,000, shall be paid by the owner of any property for which a lateral shall be installed after construction of the main line has been completed. The amount of the charge shall include the costs of the road opening, excavation, lateral installation, road closing and repaving, together with any other necessary services. Payment of the sum of $1,000 shall be made to the borough at the time of the application for installation of the lateral, with the balance, if any, to be paid within 90 days of the certification of costs by the Borough Engineer to the Borough Clerk and the provision of notice thereof to the owner of the property.
A.
Prior to the covering of any excavation made for the purpose of connecting
any building to the sewer lateral, the owner of such building shall
make application to the Borough Clerk for an inspection of such connection
and pay an inspection fee of $25. Such excavation shall not be covered
until such connection has been certified as satisfactory by an inspector
authorized by the Borough of Pine Beach.
B.
Any person violating this section of this article shall be subject,
upon conviction, to a fine not to exceed $1,000 imprisonment for a
term not to exceed 90 days or community service for a period not to
exceed 90 days and shall be further liable to the Borough of Pine
Beach for the costs of reexcavating the affected property for the
purpose of making such inspection.[1]
All charges and costs payable to the Borough of Pine Beach pursuant
to this article shall be liens against the properties affected and
shall be collected and enforced in the same manner as assessments
for local improvements as provided by N.J.S.A. 40:63-61.
