There is hereby established in the Borough of Pine Beach an
ordinance prohibiting smoking and the use of tobacco products in schools
and recreation areas.
SMOKING
The use of a lighted cigar, cigarette, pipe or any other
material which contains tobacco or similar substances.
The Board of Education of the District shall make and enforce
regulations prohibiting the smoking of tobacco or use of tobacco products
anywhere in its buildings or on its grounds. These regulations shall
not apply to classroom instruction or a theatrical production.
Recreational permit holders within the Borough of Pine Beach
may make and enforce regulations prohibiting the smoking of tobacco
or use of tobacco products in those recreational buildings or on those
recreational grounds. The person responsible for the administration
of the school or the holder of the recreational permit or any designee
of the superintendent or the holder of the recreational permit or
any other person having control of school property or recreational
property or any agent thereof or any police officer or other public
employee engaged in the execution or enforcement of law or this chapter
may sign a complaint against any individual for violation of the provisions
of this act.
Every public entrance to a school shall be posted by the person
who has control over the building, with a sign indicating that smoking
or the use of tobacco products is prohibited in the building. School
grounds or grounds under the control of or jurisdiction of the holder
of a recreational permit shall be posted with signs indicating that
smoking or the use of tobacco products is prohibited. Each sign required
by this chapter shall be located so as to be clearly visible to the
public and shall contain letters or symbols with contrast in color
with the sign.
Any person who violates the provisions of this chapter shall
appear before the Pine Beach Municipal Court and shall be subject
to the following punishment.
A. First offense: A fine of up to $100 and/or 15 hours of community
service.
B. Second offense: A fine of up to $100 and/or 30 hours of community
service.
C. Third and subsequent offenses: A fine of up to $250 and/or up to
50 hours of community service.
