Off-street parking, unloading and service requirements of this
article shall apply and govern in all present and future zoning districts
within the Borough of Pine Beach. No land shall be used or occupied,
no structure shall be designed, created, altered, used or occupied
and no use shall be operated or maintained unless off-street parking
and loading facilities are provided in at least the amount required
by this article; provided, however, that any use in operation on the
effective date of this chapter is not affected by the provisions of
this article until such time as the existing gross floor area is increased.
Where the off-street parking facility for a proposed building or use cannot be provided on the site occupied by said building or use but is provided in accordance with the provisions of §
175-43A of this article, the applicant shall submit with his application for a building permit an instrument, duly executed and acknowledged, which accepts as a condition for the issuance of the building permit and/or occupancy permit the continued availability of said off-street parking facilities, and an instrument satisfactory to the borough to effectuate the same must be recorded in the office of the Ocean County Clerk prior to the issuance of a certificate of occupancy.
The requirements in this chapter for off-street parking space
shall be a continuing obligation. It shall be unlawful for any owner
or tenant of any land or building affected by the regulations contained
herein to discontinue, change or dispense with said off-street parking
and/or loading facilities without establishing alternate off-street
parking and/or loading facilities which comply with the requirements
of this chapter and which receive municipal approval.
