The purpose of this article is to establish provisions regulating the location and set back areas of all development residential and commercial along the Route 9 corridor to accommodate the Desirable Typical Section as defined by N.J.A.C. 16:47-1.1 et seq. The goals of this article are:
A. 
To provide adequate right-of-way throughout the entire municipal Route 9 corridor while minimizing the total number of encroachments therein.
B. 
To encourage the location of all site development improvements outside the Desirable Typical Section.
DESIRABLE TYPICAL SECTION
The desired right-of-way width of State Highway Route 9 as defined by N.J.A.C. 16:47-1.1 et seq.
SITE IMPROVEMENTS
Improvements can be defined as any principal or accessory building, parking area, vehicular circulation aisle and/or stormwater detention/infiltration facility.
All applications for development along the Route 9 corridor in the municipality shall be required to conform to the provisions contained herein.
Existing site improvements shall not be required to conform to the provisions contained herein until such time as the property is subject of an application for amended site plan or expansion.
All site improvements shall be designed to clearly depict the DTS on all site plan and subdivision application maps.
No site improvements or encroachments shall be located within the DTS as herein defined.
