The office of City Administrator is hereby created pursuant to the authority of Sections 77.042 through 77.048, RSMo.

The City Administrator shall be appointed by the Board of Aldermen of the City of Hermann with the approval of the Mayor of said City.

A. 
The City Administrator shall possess the following minimum qualifications:
1. 
Not less than twenty-one (21) years of age.
2. 
A graduate of an accredited university or college with a degree in Public Administration or another related field, or five (5) years experience in financial administration or public relations or a combination thereof.
3. 
A Master of Public Administration degree and responsible management experience is preferred.

The City Administrator shall receive such wages and benefits as the Board of Aldermen may authorize from time to time by ordinance.

The Board of Aldermen may remove the City Administrator at any time by a majority vote of its entire membership, subject only to the provisions of any written contract previously authorized by ordinance or resolution. If requested by the City Administrator, the Board shall order a hearing within ten (10) days following delivery of written notice of removal.

A. 
Duties.
1. 
The City Administrator shall be the Chief Administrative Assistant to the Mayor, and shall have general superintending control of the administration and management of the government business, offices, and employees of the City, subject to the direction and supervision of the Mayor and Board of Aldermen.
2. 
The City Administrator shall recommend to the Board of Aldermen, through the Mayor, himself or some other officer or employee to perform the duties of any office or position in the City under his control which is vacant or which lacks administration due to the absence or disability of the incumbent.
3. 
The City Administrator shall prepare and present to the Board of Aldermen an annual report of the city's affairs, including a summary of reports of department heads, and such other reports as the Board of Aldermen shall require.
4. 
The City Administrator shall assemble estimates of the financial needs and resources of the City for each ensuing year and prepare a program of activities within the financial power of the City, embodying it in a budget document with proper supporting schedules and analyses to be provided to the Board of Aldermen on or before May first (1st) of each year; and shall keep the Board of Aldermen advised of the financial condition and future needs of the City and make recommendations as he may deem desirable.
5. 
The City Administrator shall aid in the preparation of the agenda of all regular and special sessions of the Board of Aldermen; attend substantially all meetings of the Board of Aldermen; and assemble detailed reports pertinent to the agenda with recommendations concerning the matter to be discussed.
6. 
The City Administrator shall supervise the purchase of all materials, supplies, and equipment for which funds are provided in the budget; may authorize the City's department heads or supervisors to let contracts necessary for the operation or maintenance of City services for amounts up to and including one thousand dollars ($1,000.00); let contracts necessary for the operation or maintenance of City services for amounts up to and including five thousand dollars ($5,000.00); receive sealed bids for purchases or contracts in excess of five thousand dollars ($5,000.00) and present them to the Board for approval; and advise the Board on the advantages or disadvantages of the contract and bid proposals. No purchase shall be made which exceeds the current budget appropriation without a supplemental appropriation by the Board. No contract in excess of five thousand dollars ($5,000.00) and no contract for new construction shall be let except by the Board; except that emergency purchases in excess of said amount may be made by the City Administrator upon oral approval by a majority of the Board if not practical to seek a special meeting of the Board. The City Administrator may issue such rules as may be necessary to govern purchasing procedures within all City departments.
7. 
The City Administrator shall insure the efficient use of all property owned by the City; be prepared at all times to provide an accurate accounting of all property owned by the City; and insure that all such property is properly maintained and protected.
8. 
The City Administrator shall, in regard to public utilities in the City, see that all franchises are faithfully observed. The City Administrator shall see that all other franchises, permits, or privileges granted by the City are faithfully observed.
9. 
The City Administrator shall recommend to the Board of Aldermen from time to time the adoption of such measures as he may deem necessary or expedient for the health, safety, or welfare of the community or for the improvement of city services and personnel.
10. 
The City Administrator shall devote his full time to the performance of the official duties of such office and may have no other employment without prior approval of the Board of Aldermen.
B. 
Powers.
1. 
The City Administrator shall have the authority to temporarily assign any employee of the City to any department or branch thereof requiring services.
2. 
The City Administrator shall have the power to prescribe such rules and regulations as are necessary or expedient for the conduct of administrative agencies subject to his authority upon approval of the Board of Aldermen.
3. 
The City Administrator shall have the power, either by himself or by any officer or person designated by him for such purpose, to investigate or to inquire into the affairs or operation of any department, division, bureau or office of the City; and, when so authorized by the Board of Aldermen, he shall have the power to employ consultants and professional counsel to aid in such investigations, examinations, or inquiries.
4. 
The City Administrator shall have the power to advise all boards, committees, agencies, departments or officials of the City concerning matters within their appropriate area of responsibility. It shall be the duty of the City Administrator to recommend such changes, alterations, or activities in the conduct of city affairs as he shall deem conducive to greater efficiency and economy.
5. 
The City Administrator shall have the power to set aside any action taken by a department head and may supersede him in the functions of his office.
6. 
The City Administrator shall have the power to direct any department to perform the work for any other department.
7. 
The City Administrator shall have the power to designate from the city personnel such committees and the officers thereof as he shall find necessary for the proper consideration of administrative problems.
8. 
The City Administrator shall have the power to appear before and address the Board of Aldermen at any meeting.
9. 
The City Administrator shall recommend to the Board of Aldermen, through the Mayor, competent and qualified personnel in all non-elected positions of the City except for the position of City Clerk, for which latter position the City Administrator shall make recommendations to the Mayor and Board of Aldermen.
10. 
The City Administrator shall have the authority to suspend, without pay, for up to fifteen (15) days, any non-elected City Officer or employee, except for the City Clerk, for breach of any provision of the Personnel Policy or State or Federal law or other provisions of the Municipal Code or for failure to perform satisfactorily the duties of such officer or employee. The City Administrator shall notify the Mayor and Board of Aldermen of the circumstances of and reasons for any suspension, discharge or other disciplinary action no later than the next meeting of such Board.
11. 
Other powers may be delegated to the City Administrator by the Mayor or Board of Aldermen.
12. 
At no time shall the power or duties of the City Administrator supersede the action of the Mayor and the Board of Aldermen as a whole.
