There is hereby established a special division of the Police Department of the City of Hermann, to be known as the Reserve Division.

The Reserve Division of the Police Department of the City of Hermann shall consist of such Reserve Officers, not more than thirty (30) in number, as may be appointed in the manner provided in this Chapter or by other ordinances of the City of Hermann, subject to the special appointment of additional Reserve Officers under emergency conditions as hereinafter provided.

A. 
Each Reserve Officer shall be appointed by the City Administrator, upon recommendation of the Chief of Police, with the approval of the Mayor and a majority of the Board of Aldermen, with such appointment to be made in the manner provided in Article I, as amended, or by other applicable ordinances, and such appointment shall be evidenced by the execution and filing of written oaths of office and bonds as provided in such ordinance.
B. 
In the event of an emergency, as that term is hereinafter defined, appointments of Reserve Officers may be made, upon recommendation of the Chief of Police, on a temporary basis by the City Administrator, or in the event of absence or vacancy in such office, by the Mayor, without immediate approval by the Board of Aldermen. Such temporary appointment shall be effective only for the duration of such emergency, up to a maximum of seventy-two (72) hours, unless the appointment made in such manner is within said period ratified by lawful action of the Board of Aldermen. The total number of Reserve Officers appointed during such times of emergency shall not exceed thirty (30), including the number of Reserve Officers otherwise lawfully appointed.
C. 
For purposes of this Section, the term "emergency" shall mean instances of riot or civil disorder; major fire, flood, earthquake, tornado, or other natural disaster posing an immediate risk of injury to the City of Hermann and its residents; war, insurrection, or nuclear attack or hazard, or any other condition which poses a serious and immediate risk of harm or injury to the City of Hermann and its residents.

A. 
Each Reserve Officer shall be deemed a part-time employee of the Police Department of the City of Hermann. Each such Reserve Officer shall have active duties in that capacity only at such times as specifically directed and authorized by order of the Chief of Police. In no event shall any Reserve Officer be on active duty in excess of thirty-two (32) hours in any week or duty assignment period of seven (7) consecutive days. Reserve Officers shall be compensated for the actual number of hours served in such active duty, at an initial rate of five dollars ($5.00) per hour (except that the rate shall be seven dollars ($7.00) per hour when assigned to active duty during a festival as defined in Section 615.020), and thereafter at the rate specified in applicable ordinances of the City of Hermann. No Reserve Officer shall be eligible for or entitled to any benefits for overtime pay, holidays, sick leave, or vacation time. No Reserve Officer shall be compensated for his participation in any training or educational activity.
B. 
Each Reserve Officer shall be at the time of his appointment not less than twenty-one (21) years of age; a qualified voter of the State of Missouri; not indebted to the City for any overdue tax, utility charge, fine, or other debt; and of good character and health. Such officers need not be residents of the City of Hermann if otherwise qualified.

At all times when summoned into active duty as herein provided, such Reserve Officers shall be general Law Enforcement Officials, charged with the proper enforcement of all ordinances of the City of Hermann and laws of the State of Missouri within the corporate boundaries of the City and upon all property owned by the City, whether within or without said boundaries. Such Reserve Officers shall have all of the duties and powers imposed upon regular officers of the Police Department of the City of Hermann, as specified by ordinance; except that such Reserve Officers shall not have power of arrest unless certified as provided in Section 200.030 (B), shall be subject to the express limitations of Section 590.100, RSMo., shall not serve as court bailiffs and shall not have authority to accept bail or bond from persons arrested for violations of ordinances or law.

All Reserve Officers shall serve at the will of the City Administrator or Mayor and Board of Aldermen, and shall be subject to removal, suspension, or other disciplinary acts in the same manner as may be provided for regular officers or other non-elected employees of the City by ordinance or the Personnel Code. The Chief of Police may remove any such Reserve Officer from active duty at any time, with or without cause, and without such Reserve Officer thereafter being entitled to additional compensation.

A. 
The City shall furnish Reserve Officers with uniforms identifying the officers as such. Any equipment and uniforms furnished by the City of Hermann to the Police Department and entrusted to Reserve Officers shall be given proper care and maintenance by the officers having custody thereof, but shall at all times remain the property of the City of Hermann. The manner of entrusting any such equipment and uniforms to Reserve Officers shall be determined and administered by the Chief of Police.
B. 
Each Reserve Officer shall submit annually to a complete physical examination by a licensed physician selected or approved by the City of Hermann, at the expense of each such officer. The written results of such examination, including laboratory tests, shall be made available to the City within a reasonable time for inspection and copying.
