This chapter shall be known and may be cited as "The Recycling Ordinance of the Borough of Ship Bottom."

As used in this chapter, the following terms shall have the meanings as indicated:
ALUMINUM CANS
Empty all-aluminum containers used for storage of beverage and food products.
BATTERIES
Batteries used to produce electric power for land, sea or air vehicles. Household batteries are not included.
BOTTLE
A rigid or semirigid container of glass or plastic having a comparatively narrow neck or mouth.
BRUSH
All brush, tree limbs, branches and trunks not larger than 3 1/2 inches in diameter.
COMMERCIAL ESTABLISHMENTS
Those properties used primarily for commercial purposes and those multiple dwelling residential buildings containing more than four dwelling units.
CORRUGATED CARDBOARD
Corrugated cardboard of the type used to make cardboard boxes, cartons and similar corrugated material, but not including wax-coated or polycoated boxes.
DEMOLITION MATERIALS
Asphalt, concrete, tree stumps, land-clearing debris, pallets and waste lumber.
GLASS CONTAINERS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of food and beverages, excluding, but not limited to, blue or flat glass commonly known as "window glass," ceramics, Pyrex, dishes and drinking glasses and other similar products made from glass.
HOUSEHOLD BATTERIES
Small batteries used for flashlights, cameras, hearing aids, toys and similar items.
INSTITUTIONAL ESTABLISHMENTS
Those facilities that house or serve groups of people, including but not limited to, hospitals, schools, nursing homes, libraries and governmental offices.
LEAVES
All fallen leaves from trees and shrubs. Brush clippings and grass clippings are not to be included as "leaves."
MIXED PAPER
Magazines, catalogues, color inserts, envelopes (with or without cellophane windows), junk mail, sweepstake forms, office paper (fax, photocopy, computer, white ledger and envelope paper), nonmetallic wrapping paper, real estate books and NCR paper.
NEWSPAPER
Paper of the type commonly referred to as "newsprint." Expressly excluded, however, are all magazines or other periodicals as well as all other paper products of any nature whatsoever.
PERSON
Every owner, lessee and/or occupant of a residence or commercial, industrial or institutional establishment.
PLASTIC
Includes the following:
1. 
HDPE bottles such as plastic beverage bottles made of high-density polyethylene (i.e., clear milk and water bottles);
2. 
PET bottles, such as plastic beverage bottles made of polyethylene terephthalate (i.e., plastic soda bottles);
3. 
PVC plastic bottles, such as plastic bottles made of polyvinyl chloride (i.e., salad dressing, shampoo, conditioner, lotion, liquid laundry detergent, bleach, fabric softener, liquid household detergent and liquid cleanser bottles).
RECYCLABLE MATERIALS
Those materials which would otherwise become municipal solid waste and which may be collected, separated or processed and returned to the economic mainstream in the form of raw materials or products as provided in this section.
RESIDENCE
Any occupied single- or multifamily dwelling having up to four dwelling units per structure.
SOLID WASTE
All garbage and rubbish normally produced by the occupants of commercial, industrial and residential property and disposed of by private or public pickup.
TIN AND BIMETAL CANS
All empty disposable cans made of tin, steel or a combination of metals used for the storage of beverage and food products.
TIRES
Tires used on automobiles only.
USED MOTOR OIL
Motor oil which is uncontaminated by any other material and has served its intended end use.
WHITE GOODS
Any household appliance, device or instrument operated by electricity or gas and designed for household use.

A. 
It shall be mandatory for all persons, including but not limited to, owners, lessees and/or occupants of residential property to separate designated recyclable materials from all other solid waste produced by such residences for collection and/or disposal at a recycling center for the ultimate recycling of such material.
B. 
It shall be mandatory for all persons, including but not limited to, owners, lessees and/or occupants of business, commercial and industrial property and of private, public and governmental institutions and buildings to separate designated recyclable materials from all other solid waste for collection and/or disposal at a recycling center for the ultimate recycling of such material.
C. 
Designated recyclable materials shall be as follows:
1. 
Aluminum cans;
2. 
Batteries;
3. 
Brush;
4. 
Corrugated cardboard;
5. 
Glass containers;
6. 
Household batteries;
7. 
Leaves;
8. 
Mixed paper;
9. 
Newspaper;
10. 
Plastic;
11. 
Tin and bimetal cans;
12. 
Tires;
13. 
Used motor oil;
14. 
White goods.
D. 
It is unlawful to dispose of used motor oil in any manner other than through an authorized used oil collection site as per this section. On and after the adoption of this chapter and in accordance with existing state regulations (N.J.A.C. 7:26A-6 et seq., and amendments thereto), all service stations, oil retailers and motor vehicle reinspection stations which use oil holding tanks shall accept up to and including 10 quarts of used motor oil per day from individuals changing oil from cars, lawn mowers, motorcycles and other motorized vehicles and machinery and shall post a sign informing the public that they are a used oil collection site.
E. 
The Borough recycling center shall be designated as a used oil collection site for use by residents for the disposition of used motor oil. Residents may bring up to five gallons at a time of used motor oil generated by changing oil from cars, lawn mowers, motorcycles and other motorized vehicles and machinery which are operated for the personal use of residents. Oil may not be mixed with any other material or liquid and must be brought in a clean disposable container.
F. 
It is unlawful for any person to place out for municipal garbage collection asphalt, concrete, stumps, land-clearing debris and wood pallets from construction and demolition projects for which a building permit is required.
G. 
It shall be mandatory for all nonresidential establishments not served by the Borough recycling program and all businesses and/or organizations or individuals who provide a pickup service and/or market for recyclable materials from the Borough to provide a record to the Borough of the types and quantities of materials recycled. Weight receipts and/or letters on official company stationery should clearly describe the source, quantity of disposition of each material, including the name and address of the market where the material was disposed of, and shall be submitted quarterly. All nonresidential establishments shall further provide the Borough with the name and address of both the solid waste hauler and recycling hauler utilized where other than that provided by the Borough, and shall further provide information to the Borough of any change of either hauler within 30 days of such change.
H. 
It shall be prohibited for any person or business to place any refrigeration unit at the curbside for pickup without first obtaining a Borough sticker or having a "freon removed" certification seal attached to the unit.

A. 
The governing body may establish and maintain one or more dropoff centers for the convenience of residents of the Borough for disposition of recyclable materials generated by their personal use. Dropoff centers will be for the use of residents of the Borough for disposition of recyclable materials generated by their personal use only.
B. 
Recyclable materials as set forth by this chapter and generated from the personal use of residents may be brought to Borough-operated recycling centers during normal operating hours. It shall be at violation of this chapter for any resident to drop off recyclable materials at the recycling center at any time other than normal operating hours as posted at the dropoff center.
C. 
Specially marked containers and/or areas shall be maintained at the recycling center for recyclable materials as set forth by this chapter. All recyclable materials must be placed in the proper container and/or area, which shall be plainly marked. It shall be a violation of this chapter for any resident to place recyclable materials anywhere either inside or outside the recycling center except the designated areas.

A. 
The governing body may use Borough personnel to collect recyclable material set at curbside and/or from a dropoff center and shall sell the recyclable material if a market exists therefor pursuant to N.J.S.A. 40A:11-1 et seq.
B. 
The governing body may elect to enter into agreements with qualified persons or corporations authorizing them to collect such recyclable material at curbside and/or from a dropoff center and to sell such recyclable material.

A. 
Recyclable material as set forth by this chapter shall be the property of the Borough once placed on the curbside or brought to a dropoff center.
B. 
It shall be a violation of this chapter for any person unauthorized by the governing body to remove, pick up or cause to be picked up any recyclable material as defined in Section 8.24.020 from the curbside or from a dropoff center. Each such collection in violation of this section shall constitute a separate and distinct offense punishable as provided in Section 8.24.090 below.

A. 
Those materials required to be recycled in the Borough pursuant to this chapter shall be placed for collection in such manner and at such times as provided for in the rules and regulations promulgated by the recycling coordinator.
B. 
Haulers shall be prohibited from collecting solid waste which contains materials required by ordinance to be separated for the purpose of recycling.

The code enforcement officer and police officers of the Borough shall be responsible for the enforcement of the provisions of this chapter.

A. 
Any person, firm or corporation violating any provisions of this chapter shall be subject to a fine of not less than $50 and not more than $1,000 for each offense.

There shall be a fee of $20 for the purchase of a Borough refrigeration removal sticker. This fee covers the removal of freon from refrigeration units mandated by the state of New Jersey.

No person shall dispose of fallen leaves including but not limited to pine needles and grass by placing the same out for regular garbage collection.
