As used in this chapter, the following terms shall have the
meanings indicated:
SIDEWALK SALE
The sale, exchange, or display for sale of stock of goods,
wares, commodities, or merchandise conducted on or about lands and
premises owned or controlled by a retail facility in a permitted commercial
zone.

A. Sidewalk sales shall be permitted only in accordance with the terms
of this chapter.
B. The Mayor and Council may elect to authorize Borough-wide sidewalk
sales on dates and at times and pursuant to terms and conditions as
it deems necessary and proper.
C. Owners and lessees of commercial properties may make application
to the Mayor and Council for authorization of a sidewalk sale. Permission
for outdoor display and sale shall only be given at the discretion
of the Mayor and Council. The following conditions are required, and
the Mayor and Council may require any additional terms and condition
to any approval as it deems necessary and proper.
1. The applicant leases or owns the property at which the sidewalk sale
is proposed.
2. No food or foodstuffs are displayed or offered for sale.
3. The outdoor display and sale are restricted to areas zoned for business
and are in accord with all zoning regulations pertaining thereto.
4. The outdoor display or sale shall be limited to the area owned or
leased by the applicant and shall leave a minimum of four feet of
sidewalk width for pedestrians.
5. Approval will not adversely affect the public health, welfare, and
safety.
6. The requested time period is no greater period of time than two consecutive
days, with appropriate provisions for alternate days because of inclement
weather.
7. No owner or lessee shall apply for more than two sidewalk sale applications
per calendar year. Borough-wide sidewalk sales authorized by the Mayor
and Council shall not apply to that limit.

A violation of this chapter shall be punishable as provided in Title 1, General Provisions, Chapter
1.08, General Penalty.
