It is the purpose of this chapter to assure that parades and special events as defined below may be held in the streets and parks of the Borough of Lawnside with no undo disruption to traffic flow in a manner that protects the public safety and insures the free and safe flow of traffic in the Borough of Lawnside. It is further the purpose of this chapter to honor the First Amendment rights of speakers to the fullest extent.
For the purpose of this chapter, the following definitions shall apply:
PARADE
Any procession or moving group of 25 or more people in or upon any street in the Borough of Lawnside.
SPECIAL EVENT
Any gathering or assemblage of 25 or more people such as large social events generating a parking and/or traffic situation that would interfere with the movement of normal traffic and/or emergency vehicles in the Borough of Lawnside.
No parade or special event shall be held in the Borough of Lawnside unless a permit has been obtained as set forth herein, except that the following shall be exempted from complying with the requirements set forth in this chapter:
A. 
Funeral and wedding processions.
B. 
A governmental agency acting within the scope of its function.
C. 
Students participating in educational activities provided that such conduct is under the immediate direction and supervision of the school authorities.
A. 
An application for a permit to conduct a parade or special event shall be made to the Director of Public Safety, in writing, by the person or persons in charge of or responsible for such parade or special event. The application for a permit shall be filed no later than five days before the scheduled date of the parade or special event.
B. 
A fee of $15 shall accompany such request and shall be used to reimburse the borough for its administrative costs in issuing a permit.
C. 
Such application for a permit shall contain the following information:
(1) 
The name, address and telephone number of the person requesting the permit.
(2) 
If the parade or event is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization and of the authorized and responsible heads of such organization.
(3) 
The name, address and telephone number of the person(s) who will act as chairperson of the parade or special event and be responsible for its conduct.
(4) 
The date when the parade or special event is to be conducted, which will include an alternate rain date, if any, and the commencing and terminating times.
(5) 
The estimated number of persons, animals and vehicles which will constitute such parade or special event, the type of animals and description of the vehicles.
(6) 
The route to be traveled, the starting point and the terminating point.
(7) 
The location of the parade or special event, and the plans for assembly and dispersal of the participants.
(8) 
A statement as to whether the parade or special event will occupy all or only a portion of the width of the street proposed to be traveled.
(9) 
The location, by streets, of any assembly areas for such parade or special event.
(10) 
The time at which units of the parade will begin to assemble at any such assembly area or areas.
(11) 
Whether or not any music will be provided, either live or recorded and the number, types and locations of all loudspeakers and amplifying devices to be used.
(12) 
Whether any admission fee will be charged for participating in the parade or special event.
(13) 
If the parade or special event is designed to be held by and on behalf of or for any person other than the applicant, the applicant for such permit shall file with the Director of Public Safety a communication in writing, from the person proposing to hold the parade, authorizing the applicant to apply for the permit on his or her behalf.
A. 
The Director of Public Safety shall issue a parade or special event permit unless he finds, based on the specific facts relevant to the proposed parade or special event, that the conduct of the parade or special event will unduly preclude the safe use of the streets, highways and thoroughfares in the borough or unduly interfere with police service, ambulance service or firefighting efforts in the borough.
B. 
Notice of approval or disapproval of the application shall be given by the Director of Public Safety to the applicant no later than two full business days from the date of the filing of the application, not including weekends or holidays. In the event of a denial of an application, a written explanation of the reasons for same shall be provided to the applicant.
A. 
The Director of Public Safety in denying any application for a parade or special event permit shall be empowered to suggest to the applicant an alternative parade route, time or date for the applicant's consideration. Any applicant desiring to accept an alternate permit shall, within three days after notice of the action of the Director of Public Safety, file a written notice of acceptance with the borough's Director of Public Safety. An alternate parade or special event permit shall conform to the requirements of and shall have the effect of a parade permit under this chapter.
B. 
Where there is more than one parade or special event application for the same date, the application received first will be granted the parade or special event permit, provided that all of the conditions of this chapter are complied with. The Director of Public Safety shall have the authority to grant a special event permit for more than one large social event for any one twenty-four-hour period unless it determines that such action will violate the standards set forth in Section 105-5.
C. 
For the purpose of public safety and welfare, the Director of Public Safety may order the temporary closing of streets during the parade or special event and shall direct the posting of proper warning or directional signs in connection therewith.
Immediately upon the issuance of a parade or special event permit, the Director of Public Safety shall send a copy thereof to the following:
A. 
The Mayor.
B. 
Borough Administrator.
C. 
Borough Attorney.
D. 
Fire Chief.
Each parade or special event permit shall state the following information:
A. 
Starting time;
B. 
Minimum speed;
C. 
Maximum speed;
D. 
Maximum interval of space to be maintained between the units of the parade;
E. 
The portions of the streets to be traveled that may be occupied by the parade;
F. 
The maximum length of the parade, in miles or fractions thereof;
G. 
Such other information as the Director of Public Safety shall find necessary for the enforcement of these provisions of this chapter.
The parade or special events chairman or other person heading or leading such activity shall carry the required permit upon his person during the conduct of any parade or special event.
A. 
Interference. No person shall unreasonably hamper, obstruct or impede or interfere with any parade or special event or parade assembly or with any person, vehicle or animal participating or used in a parade or special event.
B. 
Driving through parades or special events. No driver of a vehicle shall drive between the vehicles or persons comprising of a parade or special event when such vehicle or persons are in motion and are conspicuously designated as a parade or special event.
C. 
Parking on parade or special event routes. The Director of Public Safety shall have the authority, when reasonably necessary, to prohibit or restrict the parking of vehicles along a roadway or part thereof constituting a part of the route of the parade or special event. The Director of Public Safety shall post signs to such effect, and it shall be unlawful for any person to park or leave any vehicle in violation thereof. No person shall be liable for parking on a street that is unposted.
All ordinances or parts thereof inconsistent with the provisions of this chapter are hereby repealed as to such inconsistency.
If any section, paragraph, subdivision, clause or provision of this chapter shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged, and the remainder of this chapter shall be deemed valid and effective.
Any person, firm or corporation found guilty in the Municipal Court of the Borough of Lawnside of a violation of the terms of this chapter shall be subject to a fine of not more than $1,000, or imprisonment for a period not exceeding 90 days, or both at the discretion of the Municipal Court Judge.
