It is the purpose of this chapter to assure that parades and
special events as defined below may be held in the streets and parks
of the Borough of Lawnside with no undo disruption to traffic flow
in a manner that protects the public safety and insures the free and
safe flow of traffic in the Borough of Lawnside. It is further the
purpose of this chapter to honor the First Amendment rights of speakers
to the fullest extent.
For the purpose of this chapter, the following definitions shall
apply:
PARADE
Any procession or moving group of 25 or more people in or
upon any street in the Borough of Lawnside.
SPECIAL EVENT
Any gathering or assemblage of 25 or more people such as
large social events generating a parking and/or traffic situation
that would interfere with the movement of normal traffic and/or emergency
vehicles in the Borough of Lawnside.
No parade or special event shall be held in the Borough of Lawnside
unless a permit has been obtained as set forth herein, except that
the following shall be exempted from complying with the requirements
set forth in this chapter:
A. Funeral and wedding processions.
B. A governmental agency acting within the scope of its function.
C. Students participating in educational activities provided that such
conduct is under the immediate direction and supervision of the school
authorities.
Immediately upon the issuance of a parade or special event permit,
the Director of Public Safety shall send a copy thereof to the following:
Each parade or special event permit shall state the following
information:
D. Maximum interval of space to be maintained between the units of the
parade;
E. The portions of the streets to be traveled that may be occupied by
the parade;
F. The maximum length of the parade, in miles or fractions thereof;
G. Such other information as the Director of Public Safety shall find
necessary for the enforcement of these provisions of this chapter.
The parade or special events chairman or other person heading
or leading such activity shall carry the required permit upon his
person during the conduct of any parade or special event.
All ordinances or parts thereof inconsistent with the provisions
of this chapter are hereby repealed as to such inconsistency.
If any section, paragraph, subdivision, clause or provision
of this chapter shall be adjudged invalid, such adjudication shall
apply only to the section, paragraph, subdivision, clause or provision
so adjudged, and the remainder of this chapter shall be deemed valid
and effective.
Any person, firm or corporation found guilty in the Municipal
Court of the Borough of Lawnside of a violation of the terms of this
chapter shall be subject to a fine of not more than $1,000, or imprisonment
for a period not exceeding 90 days, or both at the discretion of the
Municipal Court Judge.
