The following schedule of fees is hereby established for the furnishing of copies of ordinances, reports and other papers set forth or otherwise available to the public pursuant to ordinances of the Borough of Pine Beach or state laws:
A. 
All requests for government records shall be subject to the payment of fees as follows as established by N.J.S.A. 47:1A-5b.
(1) 
Basic per page copy fees, actual cost not to exceed:
(a) 
8 1/2 x 11: $0.05 per page.
(b) 
8 1/2 x 14: $0.07 per page.
(c) 
Should the actual costs to produce paper copies exceed the $0.05 and $0.07 rates, the municipality may charge the actual cost of duplication;
(d) 
The Borough will provide electronic records free of charge (i.e. records sent via e-mail and fax); and
(e) 
The Borough will charge the actual cost to provide records in another medium (i.e. computer disc, CD-ROM, DVD).
(2) 
If the Borough demonstrates that its actual costs for duplication of a government record exceed the foregoing rates, the Borough shall charge the actual cost of duplicating the record. The actual cost of duplicating the record, upon which all copy fees are based, shall be the cost of materials and supplies used to make a copy of the record. Access to electronic records and non-printed materials shall be provided free of charge, but the public agency may charge for the actual costs of any needed supplies such as computer discs. (3) 
Special Service Charge; Extraordinary expenditure of time and effort.
(a) 
Special Service Charge. Whenever the nature, format, manner of collation, or volume cannot be reproduced by ordinary document copying equipment in ordinary business size or involves an extraordinary expenditure of time and effort to accommodate the request, the public agency may charge in addition to the actual cost of duplicating the record, a special service charge that shall be reasonable and shall be based upon the actual direct cost of providing the copy or copies; provided, however, that in the case of a municipality, rates for the duplication of particular records when the actual cost of copying exceeds the foregoing rates shall be established in advance by ordinance. The requestor shall have the opportunity to review and object to the charge prior to it being incurred. (N.J.S.A. 47:1A-5)
(b) 
Actual direct cost means the hourly rate of the lowest level employee capable of fulfilling the request and does not include fringe benefits.
(c) 
Only warranted when:
[1] 
Copies cannot be reproduced by ordinary copying equipment in ordinary business size.
[2] 
Accommodating request involves an extraordinary expenditure of time and effort, including inspection of records.
B. 
Police: accident reports shall be charged the fees as permitted under N.J.S.A. 47:1A-5b.
Mail requests: shall include the actual cost of postage plus $0.25 per request. (N.J.S.A. 47:1A-5b)
C. 
Photocopy: $0.25 per page (copy fee only, does not apply to records requests).
D. 
Notary services fee per document is in accordance with the State of New Jersey, Department of the Treasury schedule.

E. 
Certified copy of a document: $12.

F. 
Duplicate tax sale certificate. The fee for the issuance of a duplicate tax sale certificate is hereby established at $100.

H. 
Certificate of redemption. The fee for a certificate of redemption is $50.

I. 
Imposition of service charge; electronic fees. A service charge in the amount of $20 per request or a $200 annual fee paid in advance shall be imposed for any electronic file requested. The Borough Council authorizes the appropriate municipal officer to collect such fee and deposit in the borough treasury. This fee does not apply to mortgage companies and mortgage servicing companies in connection with the direct billing and payment of real estate taxes.
