No person shall be on the City Park grounds from after 11:00
P.M. until 5:00 A.M. during the months of May, June, July, August
and September or from after 9:00 P.M. until 5:00 A.M. during the months
of October, November, December, January, February, March and April
without special permit granted hereunder.

A. The
Park Board or its authorized agent may issue permits to persons, organizations
or corporations to conduct activities on the City Park grounds after
curfew after receiving application from the persons, organization
or corporation stating the approximate number of persons to attend
the activity, type of activity, the expected time to cease activity
and the portion of the City Park to be used. The Park Board or its
authorized agent may approve such application if the activity and
park area to be used and the extension of time past curfew is reasonable
in that the activity is properly supervised, controlled and organized,
the use is for a lawful purpose and undue noise shall not be created
by the activity.
B. Campers
in the camping area on the City Park grounds shall be under the same
requirements and shall be restricted to the camping area; provided,
however, that campers may be issued a permit for use of camping space
and restrooms in the camping area for sleeping and resting purposes
only, past curfew by the Chief of Police or his authorized agent upon
collection of a camping fee. The provision for issuance of a permit
by the Chief of Police does not exclude issuance of a permit by the
Park Board or its authorized agent for camping past curfew.
C. The
Park Board shall notify the Chief of Police of the permits granted
and areas to be used.

A. The
"
City Park grounds" shall include the following areas:

1. Those areas owned by the City of Hermann enclosed by Washington Street
on the west, by Eleventh Street on the south, by the road around the
ballpark levee on the east and the alley located south of West Ninth
Street on the north to include Lot 23 and the East half of Lot 25
on West Ninth Street; and enclosed by Washington Street and the street
around the ballpark levee on the north, Frene Creek on the east and
State Highway No. 100 on the south; excepting however, the area controlled
by and in the possession of Hermann Fire Company No. 1, Inc.
2. The area owned by the City of Hermann and known as the "Sesquicentennial
Park", bounded by East Third Street on the south, Gutenberg Street
on the east, the alley between East Second Street and East Third Street
on the north, and the centerline of Lot 27 on East Third Street on
the west (measuring one hundred twenty (120) feet by two hundred seventy
(270) feet).

The area owned by the City of Hermann consisting of the east
forty (40) feet of Lot 28 and all of Lots 30, 32, 34, and 36 on East
Fourth Street, the east part of Lot 25 and all of Lots 27, 29, 31,
33, and 35 on East Fifth Street.
4. The area owned by the City of Hermann and known as the "Riverfront
Park," bounded by the south bank of the Missouri River on the north,
the west bank of Frene Creek on the east, the north line of the Missouri
Pacific Railroad right-of-way on the south and the east line of Schiller
Street extended on the west.
5. The area owned by the City of Hermann and known as the "George Johnson
Park" bounded by the south line of the Missouri Railroad right-of-way
on the north and consisting of parts of Lots 8, 9 and 10 on West Wharf
Street.
B. The
streets of Gasconade, Eleventh, Twelfth, and the street around the
ballpark levee shall remain open streets for vehicular traffic during
the curfew hours; provided however, that the unnamed street connecting
Gasconade Street with the street around the ballpark levee shall be
subject to curfew and closed for traffic during curfew.

Signs shall be placed at various locations within the park grounds
and at all street and walkway entrances to the park grounds bearing
the legend:
Park closed from 11:00 P.M. until 5:00 A.M. May through September
and 9:00 P.M. until 5:00 A.M. October through April.
