A. Position Created. Pursuant to N.J.S.A. 40A:9-136, there is created
the position of Borough administrator.
B. Appointment — Term — Compensation.
1. The Borough administrator shall be appointed by the mayor, with the
advice and consent of the Borough council in accordance with N.J.S.A.
40A:9-137.
2. The term of office of the Borough administrator shall be at the pleasure
of the governing body.
3. The administrator shall receive as salary such sums as may be fixed
and adopted by the Borough council in the annual salary and wage ordinance.
C. Removal from Office. The Borough administrator may be removed by
a two-thirds vote of the governing body. The resolution of removal
shall become effective three months after its adoption by the governing
body. In accordance with N.J.S.A. 40A:9-138, the governing body may
provide that the resolution of removal shall have immediate effect;
provided, however, that the governing body shall cause to be paid
to the administrator any unpaid balance of his or her salary and his
or her salary for the next three calendar months following adoption
of the resolution.
D. Qualifications. The Borough administrator shall be chosen on the
basis of his or her executive and administrative abilities and qualifications
with special regard as to education, training and experience in governmental
affairs. The Borough administrator shall be exempt from the residency
requirements of N.J.S.A. 40A:60-6(b)(3).
E. Vacancy. Any vacancy in the position of Borough administrator shall
be filled by appointment by the mayor with the advice and consent
of the Borough council.
F. Powers and Duties of Administrator.
1. The Borough administrator shall, under the supervision and control
of the mayor and Borough council, and to the extent not prohibited
by law, have the following duties and responsibilities:
a.
To serve as the principal administrative officer representing
the mayor and Borough council;
b.
To supervise the administration of all departments and offices,
in consultation with the respective committee chairpersons;
c.
To represent the Borough in its relation to the federal, state
and county governments and to other municipalities and to evaluate
the Borough's interest in contracts, franchises and other business
transactions as assigned by the mayor and Borough council;
d.
To study the administrative and other operations of the Borough
and make recommendations for plans and programs to meet the changing
needs of the Borough;
e.
To receive and reply to inquiries and complaints concerning
Borough business and to provide information and assistance with respect
thereto;
f.
To attend all meetings of the Borough council as required;
g.
To establish and maintain sound personnel practices and maintain
appropriate records of all employees and to have the authority to
recommend to the mayor and Borough council the initial hiring and
disciplining of all Borough employees;
h.
To recommend the nature, location and extent of public improvements
and to coordinate the execution of same when authorized by the mayor
and Borough council;
i.
To implement and enforce the policies of the mayor and Borough
council with respect to the compiling and release of public information;
j.
To supervise and continually review the Borough's insurance
program;
k.
To assist the Borough council in negotiating contracts for the
Borough as authorized by and subject to the approval of the Borough
council;
l.
To act as a liaison on behalf of the Borough with all utility
companies serving any portion of the Borough to be sure that such
utilities are providing adequately for the needs of the residents
of the Borough;
m.
To assure that the provisions of all franchises, leases, permits
and privileges granted by the Borough are complied with;
n.
To require each department to maintain adequate inventory records
of all equipment and materials owned and used by the Borough and to
arrange for the disposal of all inadequate or obsolete materials when
directed to do so by the Borough council;
o.
To assign responsibilities for departmental duties and coordinate
interdepartmental operations as authorized by the Borough council;
p.
To assist the residents of the Borough in matters within his
or her jurisdiction, to maintain a record of complaints submitted
to him or her for his or her attention, and to take proper steps to
remedy the causes for such complaints;
q.
To keep the Borough council currently informed of all matters
within his or her jurisdiction by such reports, verbally or in writing,
as he or she deems advisable or as may be requested by the Borough
council, and to submit an annual written report of his or her work
accomplished at the request of the Borough council for the benefit
of the public;
r.
To perform such other duties as may be assigned to him or her
from time to time by the mayor and/or Borough council;
s.
Nothing in this section shall derogate from or authorize the
administrator to exercise the powers and duties of the elected and
appointed officials of the Borough.
G. There is hereby created the positions of "Borough coordinator" and
"office manager," which may be filled only in the event of a vacancy
in the position of administrator. The duties of administrator shall
be allocated to the positions of Borough coordinator and office manager
pursuant to resolution adopted by the governing body. Each of these
positions shall serve at the pleasure of the governing body.

A. The chief financial officer shall determine and report annually to
the mayor and council all unfunded liabilities concerning anticipated
prospective vacation, sick, compensatory and buy-out benefits falling
due upon voluntary or involuntary separation or severance of an employee
from the municipality.
B. All payments to be made to any employee for any anticipated prospective
vacation, sick, compensatory and buy-out benefits shall only be authorized
by ordinance. The ordinance shall be published in the official newspaper
or the municipality setting forth the time and date for the public
hearing on second reading thereof. The public shall have the right
to comment on the proposed ordinance at the public hearing for second
reading.

A. As they become eligible, new employees will be advised by the Borough
administrator that they are permitted to enroll in the current health
benefit plan. It is the employee's option to accept or waive
coverage beginning with the first day of the month in permanent employee
status. Any changes in the employee's dependent status must be
reported immediately to the Borough administrator or designated responsible
employee.
B. Any employee eligible for the Borough's health benefits plan
who is also eligible for other health care coverage may waive coverage
under the Borough's plan to which the employee is entitled by
virtue of employment with the Borough. The waiver shall be made on
a form provided by and filed with the Borough administrator or designated
responsible employee.
C. Any employee waiving health benefits pursuant to Subsection
B of this section will be paid annually by the Borough a sum equal to 50% of the amount saved by the Borough because of the employee's waiver of coverage.
D. Any employee who waives health benefits pursuant to Subsection
B of this section, shall be permitted to resume coverage under the same terms and conditions as applied to initial coverage.
E. Any employee who wished to resume coverage shall file with the Borough
administrator or designated responsible employee a declaration on
a form provided by the Borough administrator.
