All sources of sewage within the Borough shall be connected
with and served by the sewerage system now or hereafter owned, constructed
or acquired by the Borough of Ship Bottom; and the owner of any building
where a sewer is available or shall hereafter be made available shall,
prior to the connection date with respect to such building, connect
the building with the sewer, pursuant to Chapter 138 of the 1946 Laws
of New Jersey, as amended. The owner and the plumber shall be responsible
for supplying the material and the installation of the sewer service
lateral from the sewer main to the cleanout at the curb, including
connection at the main, cleanout at the curb and complete trench and
street restoration, in accordance with the Water and Sewer Department
guidelines. The Water and Sewer Department will require 48 hours'
notice prior to installation in order to schedule an inspection. An
inspection fee of $50 will be required for each sewer service lateral.
A. Definitions. For the purposes of this chapter, unless the context
otherwise indicates, the following words and terms shall have the
following meanings:
BUILDING
Any house, building or other structure, temporary or permanent,
designed for either residential or industrial use, or any other source
of sewage and industrial wastes, whether privately or publicly owned.
CONNECTION DATE
With respect to presently existing and occupied buildings,
the 30 days after the completion and putting into operation of any
sewer in any street or public way on which the building abuts; with
respect to buildings in the process of construction or hereafter to
be constructed, either the 30th day after the completion of construction
or the initial occupancy of the building, whichever date is earlier.
SEWER
Any line, main, conduit, pipe or other sewage disposal facility
forming a part of the comprehensive sewerage system now or hereafter
owned, constructed or acquired by the Borough of Ship Bottom.
B. Compliance with Borough regulations. Every connection required by
this section shall extend from inside the building foundation to the
sewer and shall in all respects comply with the rules and regulations
of the board of health of the Borough and the Water and Sewer Department.
C. Order to property owners. Upon receipt by the Mayor and Borough Council
of notification from the Water and Sewer Department that the sewer
or sewers in any streets or public ways in the Borough are ready to
receive sewage or industrial wastes, the Mayor and Council shall order
each property owner along the lines of the sewer or sewers to connect
his or her building at such time in accordance with the terms of this
section. The Mayor and Council shall designate one of its proper officers
to give notice of the order to the owner or owners of the property.
D. Contents of notice. Notice shall be addressed to the owner of the
property as the name of the owner appears in the last tax duplicate
of the Borough; shall describe the property by lot and block designation
as they appear on the tax map of the Borough and by the street address;
shall state that by order of the Mayor and Council of the Borough,
the owner is required to connect the building on his or her property
with the sewer; and shall inform the owner of the penalty to be imposed
for failure to comply with the notice and order in accordance with
the terms of this section.
E. Service of notice. Notice may be served on the owner personally or
by leaving it at his or her usual place of abode with a member of
his or her family above the age of 18 years if the owner has a place
of abode within the Borough. Notice may also be served within or without
the limits of the Borough by mailing it by regular mail to the last
known post office address of the owner as the same appears on the
last tax duplicate of the Borough.
F. Rates, fees and charges. The following rates,
fees and charges shall be made and collected for the services and
facilities of the comprehensive sewerage system commencing with the
service year 2019:

1. Flat fee for single dwelling unit, whether contained in a single-family
residence, duplex, apartment, condominium or other multifamily structure
or project: $440.
2. For each additional dwelling unit, whether contained in a duplex,
apartment, condominium or other multifamily structure or project:
$440.
3. All individual multifamily units serviced by a number of meters for
the building, group of buildings or project in which the unit is located,
less than the amount of the total of the units, shall be considered
a metered unit and, in addition to the flat fees for each unit, the
corresponding gallon usage charge, as set forth below, shall be pro-rated
among such units.
4. The quarterly minimum in gallons and minimum annual charge as set
forth below for metered establishments shall, in the case of multifamily
structure or project, be multiplied by the number of individual dwelling
units contained in the multifamily structure or project.
5. In addition to all the above pertaining to a multifamily structure
and project, all metered use attributable to the multifamily structure
or project, without regard to form of ownership, and not attributable
separately to each dwelling unit, shall be charged to the owner, occupant
or association as the case may be, according to the commercial establishment
schedule set forth below.
6. Commercial property flat fee: $440.

Gallonage use over 14,000 gallons quarterly shall be charged
at the rate of $2.68 per 1,000 gallons.

If a property contains more than one category in the above schedule,
they will be billed for each such category. When a property requires
a disconnect from the sewer system, the owner and plumber shall be
responsible for disconnecting the sewer and capping the sewer lateral.
The Water and Sewer Department will require 48 hours' notice
prior to installation in order to schedule an inspection. An inspection
fee of $50 will be required for each sewer service lateral.

Inspection of disconnected sewer and cap: $50.

Tappage fee: the tappage fee for any connection to the sewer
system in the Borough, shall be as follows:
a.
The tapping fee for a single family residential unit shall be
$1,325 and for a duplex it shall be $1,325 per unit.
b.
The tapping fee for multifamily residential and non-residential
shall be $1,325 per equivalent dwelling unit (EDU). Sewer connection
fees shall be based on projected sewer consumption of the property
with each equivalent dwelling unit (EDU) comprising of 60,000 gallons
of annual sewer consumption. The calculation of the connection fees
for multifamily residential units and all nonresidential properties
shall be determined by the Borough Engineer based upon the application
and documentation provided by the applicant. Application and documentation
shall include the projected sewer consumption date supplied by the
applicant's engineer in accordance with the flow rates stipulated
in NJAC 7:14A 23.3 Projected Flow Criteria in preparing the sewer
application for approval by the governing body. It shall be within
the discretion of the Borough Engineer to request additional documentation
from the applicant as he/she deems appropriate.
c.
The amount of the connection fee shall be based upon an estimate
as calculated in accordance with the Borough's ordinances; and,
after receiving a recommendation from its Borough Engineer, the connection
fee shall be paid before issuance of a certificate of occupancy.
14.
Sewer connection reinspection fee: $50.
G. Penalty. Any person who shall violate this chapter by failing to
comply with any order issued in accordance with the provisions of
this chapter within 30 days after notice by the proper officer of
the Mayor and Council shall, upon complaint by the Borough or by any
other person, upon conviction, be subject to a fine of not more than
$100, or to imprisonment for not more than 10 days, or both, for each
violation. Each day of failure to comply with the order after the
expiration of the thirty-day limitation provided for in this section
shall constitute a separate violation of this chapter. Penalties under
this chapter may be enforced by the Borough or by any other interested
person in the municipal court of the Borough in such manner as may
be provided by law.
H. Regulations not exclusive. The provisions of this chapter shall not
be deemed to be exclusive, and the provisions and the sewer connections
directed by this section may be compelled and enforced in any manner
provided by law.
