A. Definitions.
As used in this Section the following terms shall have the meanings
indicated:
FIRE PIT
A pit dug into the ground or a free-standing metal vessel
in which a contained outdoor wood-burning fire is made.
PERMANENT OUTDOOR FIREPLACE
Any permanent outside structure built of stone or masonry
with a chimney built according to International Code Council building
codes for the purpose of burning seasoned firewood.
PORTABLE OUTDOOR FIREPLACE
A manufactured, portable, outdoor fireplace or fire pit that
is UL approved and is a product constructed of steel, concrete, clay
or other non-combustible material. A portable outdoor fireplace may
be open in design, or it may be equipped with a small hearth opening
and a short flu or chimney opening in the top. Fire rings and similar
containment devices or systems made from stones, rocks or other non-combustible
materials for the purpose of burning seasonal firewood shall be considered
portable outdoor fireplaces for the purposes of this Section.
SKY LANTERN
Also known as a Kongming lantern or Chinese lantern, is a
small hot air balloon made of paper or some other light material with
an opening at the bottom where a fire is suspended.
B. General
Regulations.
1. Fires in permanent outdoor fireplaces, portable outdoor fireplaces
and in fire pits are prohibited when atmospheric conditions or local
circumstances make such fires hazardous, as declared by the Mayor,
local Fire Department, State Fire Marshall, Missouri Department of
Natural Resources, or any other State or Federal agency.
2. Only one (1) fire shall be permitted on lots with an area less than
seven thousand two hundred (7,200) square feet. Lots with an area
greater than seven thousand two hundred (7,200) square feet may have
no more than two (2) fires burning at the same time. For purposes
of this Section, if a property owner owns two (2) or more lots with
contiguous boundaries, then the total area of the lots may be considered.
3. When any fire creates or adds to a hazardous situation or fails to
be managed or maintained in accordance with these regulations, the
Police Department is authorized to order the immediate extinguishing
of the fire.
4. Portable outdoor fireplaces and fire pits shall only be placed on
a non-combustible surface. Portable outdoor fireplaces shall not be
placed on decks made of wood or composite materials.
5. A person shall not release or cause to be released an untethered
sky lantern.
6. The City has adopted all provisions of the International Fire Code,
as amended, with respect to outdoor burning which is incorporated
herein by reference. In any instance where this Section and the IFC
address the same topic, the provisions of this Section shall control.
C. Barbeque
Pits Or Grills And Gas Fire Pits Permitted. Nothing in this Section
shall prevent persons from using standard gas or charcoal barbecue
pits or grills were manufactured UL approved outdoor gas fire pits.

It is hereby declared to be unlawful for any person other than
the Fire Chief, or firemen, or such persons as shall have their permission,
to ride on the fire trucks, either to or from a fire, or at any other
time; and it is further declared to be unlawful for any person to
tamper with, injure, destroy, or deface said fire trucks, engine houses
or any other property owned by the Fire Department of the City and
used in the fighting of fires.

After the Fire Chief or any fireman arrives at the scene of
a fire, it shall be unlawful for any person or persons except persons
financially interested in property endangered by the fire to participate
in the fighting of said fire, or trespass, except under the direction
of the Fire Chief or firemen.

A. It
shall be unlawful to obscure from view, to tamper with, to damage,
to deface, obstruct or restrict the access to any fire hydrant or
any Fire Department connection for the pressurization of fire suppression
systems ("connections"), including fire hydrants and connections located
on public or private streets and access lanes or on private property.
B. If,
upon the expiration of the time mentioned in a notice of violation,
obstructions or encroachments are not removed, the City may proceed
to remove the same. The costs incurred in the performance of the necessary
work shall be paid for by the City with the approval of the City Administrator,
and the City may, in turn, institute appropriate action against the
violator for the recovery of such costs.
C. A person
shall not use or operate any fire hydrant unless such person first
secures a permit for such use from the City Administrator. This Section
shall not apply to the use of such hydrant by a person employed by,
and authorized to make such use by the City of Hermann, Missouri.

Violation of any provision of this Chapter or of the International
Fire Code, as amended, adopted and incorporated into the Code per
Section 503.070, is a misdemeanor.
