A. 
From and after the enactment of this article, it shall be lawful for the Council of the City of Shamokin to install parking meters on any street in the City of Shamokin and to place the necessary curbing and foundation for standards and other work necessary for the installation of parking meters. However, no parking meters shall be placed before the entrance of hotels and theaters or at fireplugs or places designated as bus spaces or at any other place where parking is now or may hereafter be prohibited.
B. 
City Council shall have the power to lease and purchase parking meters as needed and to remove parking meters from any space in which the same may have been installed, upon any terms that it may designate.
The Police Department is hereby authorized to provide for the marking off of individual parking spaces in the parking zones and areas designated and described in § 490-10; said parking spaces to be designated by lines painted or marked on the curbing or surface of the highway or area. At each space so marked, it shall be unlawful to park any vehicle in such a way that said vehicle shall not be entirely within the limits of the space so designated.
A. 
In said parking meter zones, parking meters shall be installed upon the curb, sidewalk or pavement immediately adjacent to the parking spaces so designated. The Police Department shall be responsible for the regulation, control, operation, maintenance and use of such parking meters.
B. 
Each device shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin for the period of time hereinafter prescribed. Each device shall be so arranged that, upon the expiration of the lawful time limit, it will indicate by a proper, visible signal that the lawful parking period has expired, and in such case the right of such vehicle to occupy such space shall cease, and the operator, owner, possessor or manager thereof shall be subject to the penalties hereinafter provided.
A. 
When a parking space in any parking meter zone is parallel to the adjacent curb or sidewalk, any vehicle parked in such parking space shall be parked so that the foremost part of such vehicle shall be nearest to the parking meter; provided, however, that where double parking meters are installed upon one standard so as to serve two parking spaces, any vehicle parked in the space just beyond the parking meters shall be parked so that the rear bumper of such vehicle shall be nearest to the parking meters. When a parking space in any parking meter zone is diagonal to the curb or sidewalk, any vehicle parked in such parking space shall be parked with the foremost part of such vehicle nearest to such meter.
B. 
Where lines or markings are painted or placed upon the curb, sidewalk, highway and/or paved surface adjacent to each parking meter, providing for parking at an angle and not parallel or perpendicular to the curb, it shall be unlawful for the operator of any motor vehicle to cross the center line of the highway to enter or leave said parking area.
When any vehicle shall be parked in any space adjacent to which a parking meter is located in accordance with the provisions of this article, the operator shall, upon entering the said parking space, immediately deposit or cause to be deposited such coin or coins of the United States as are required for such parking meter and as are designated by proper instructions on the parking meter, and failure to deposit such coin or coins shall constitute a breach of this article and shall subject such person to the penalty prescribed hereafter. Upon the deposit of such coin or coins and placing said meter in operation, the parking space may be lawfully occupied by such vehicle during the period of parking time which has been prescribed for the zone in which said parking space is located and for which a coin or coins is or are deposited as indicated on the parking meter. If said vehicle shall remain parked in any such parking space beyond the parking time limit so fixed for such parking space, the parking meter shall, by its violation signal, dial or pointer, indicate such illegal parking and, in that event, such vehicle shall be considered as parked overtime and beyond the period of legal parking time. The parking of a vehicle overtime or beyond the period of legal parking time in any such space where any such parking meter is located shall be a violation of this article and punishable as hereinafter set forth.
It shall be unlawful and a violation of the provisions of this article for any person to:
A. 
Cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described or to deposit in any parking meter any coin for the purpose of parking beyond the maximum legal parking time for the particular parking meter zone.
B. 
Permit any vehicle to remain or be placed in any parking space adjacent to any parking meter while said meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space.
C. 
Park any vehicle across any line or marking of a parking meter space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings.
D. 
Deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article.
E. 
Deposit or cause to be deposited in any parking meter any slug, device or metal substance or other substitute for lawful coins.
F. 
Park or permit the parking of any vehicle in any parking meter space where the meter does not register lawful parking.
G. 
Park at any parking meter zone a motor vehicle with a total body length of eight feet or more.
It shall be the duty of the police officers of the City of Shamokin and such other persons as may be designated and authorized by the Chief of Police, acting in accordance with instructions issued by the Chief of Police, to report:
A. 
The number of each parking meter which indicates that the vehicle occupying the parking space and adjacent to such parking meter is or has been parked in violation of any of the provisions of this article.
B. 
The state license number of such vehicle.
C. 
The date and hour of such violation.
D. 
Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation.
It shall be the duty of the Chief of Police to designate some proper person or persons to make regular collections of the moneys deposited in said meters.
A. 
Temporary suspension of provisions. The provisions of this article may be temporarily suspended by the Mayor, and he may prescribe, temporarily, such other rules and regulations as traffic conditions may require.
B. 
Suspension of provisions on designated holidays. The use of parking meters throughout the City of Shamokin is hereby dispensed with on Sundays and the following holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day.
C. 
Erection of signs. The Mayor is authorized to erect or cause to be erected appropriate signs notifying the operators of motor vehicles of the provisions of this article.
D. 
Tokens. Where the deposit of any coin or coins is required under the provisions of this article, it shall be permissible to use such token or tokens for that deposit as shall be designated and approved by the Mayor.
A. 
Where parking meters have been installed on streets designated as "metered," as provided in Article II, Traffic and Parking, § 490-41, adopted May 6, 1968, or are installed pursuant to the provisions of this article, the same shall be known as "on-highway parking zones." Where parking meters have been installed on parking lots established by City Council, they shall be known as "off-highway parking zones." On-highway parking zones and off-highway parking zones are herein referred to collectively as "parking meter zones."
B. 
It shall be unlawful for any owner or operator of any motor vehicle to park such vehicle between the hours designated or printed on the card attached to said meter on any day, except Sundays and regular holidays, for longer than the time indicated on the printed card attached to said meters.
A. 
Upon parking any vehicle in a parking meter zone, the operator thereof shall, upon entering the designated parking space, immediately deposit or cause to be deposited in the parking meter controlling such parking space the proper coin of the United States as designated for such parking on such parking meter.
B. 
Upon the deposit of such coin as hereinabove set forth and the placing of the meter in operation, such parking space may be lawfully occupied by a vehicle during the period of parking time as indicated on the parking meter.
C. 
Parking meters will accept only United States currency for the following periods and time limits:

(1) 
Anthracite Street, Arch Street, Chestnut Street, Eighth Street, Independence Street, Liberty Street, Market Street, Ninth Street, Orange Street, Shamokin Street, Sunbury Street and Washington Street: $0.25 per 1/2 hour, with a two-hour limit;
(2) 
Commerce Street and Lincoln Street: $0.25 per hour, with a ten-hour limit;
(3) 
Water Street from 9th Street to Rock Street and the entire metered portion of Rock Street: $0.25 per hour, with a ten-hour limit;
(4) 
Water Street parking lot (between Market Street and Eighth Street): $0.25 per hour, with a ten-hour limit:
(5) 
The metered portion of the Independence Street East End parking lot (between Washington Street and Rock Street): $0.25 per hour, with a four-hour limit;
(6) 
The Independence Street West End lot (located parallel to and to the west of Eight Street): $0.25 per hour, with a two-hour limit;
(7) 
Notwithstanding the above, any meter designated as a fifteen-minute meter: $25 for 15 minutes, with a fifteen-minute time limit.

Any person who causes, allows or permits any vehicle to be parked overtime or beyond the period of legal parking time established for any parking meter zone shall pay to the City an overtime parking charge in the amount of $10. After 48 hours, meter fines are $12. Failure to respond within 10 days will result in additional costs for all tickets.

A. 
Whenever any vehicle is caused, allowed or permitted by any person to be parked in any parking meter zone for a time longer than is permitted by this article, any duly authorized employee of the City, under the direction of the Mayor and the Director of Public Safety, shall notify such person of the applicable overtime parking charge by placing a written notice or ticket under the windshield wiper or in some other conspicuous place on such vehicle indicating the time of the violation. Unless the overtime parking charge is paid within 48 hours, an additional late charge of $7 shall be added. This additional late charge shall increase to $10 if after 10 days the overtime parking charge has not been paid.

B. 
All overtime parking charges, including any additional late charges, shall be paid to the City not later than 20 days after the date of the violation, and the notice or ticket placed on the vehicle at the time of the violation shall advise the owner or operator of such vehicle that, unless the overtime parking charges, including additional late charges, are paid within the time limits herein specified, the fine payable upon conviction of overtime parking and failure to pay such charges within the time set forth above shall be not less than $15 nor more than $25 and costs of prosecution for each offense and, in default of the payment of said fine and costs of prosecution, imprisonment in the county jail for a period of not more than five days.
In any proceeding for a violation of the provisions of this article, the registration plate displayed on such vehicle shall be prima facie evidence that the owner of such vehicle was then operating the same. If at any hearing or proceeding the owner shall testify under oath or affirmation that he was not operating such vehicle at the time of the alleged violation of this article and shall submit himself to an examination as to who at that time was operating such vehicle and reveal the name of the person, if known to him, then the prima facie presumptive evidence arising from the registration plate shall be overcome and removed and the burden of proof shifted.

Whoever violates § 490-6B, C, E, F or G as set forth in this article shall be fined $15.
A. 
The provisions hereof shall not apply to physicians or surgeons while in the pursuit of their calling, or to any vehicle owned by a business firm, including a tradesman such as an electrician, a plumber, a carpenter, a roofer, etc., that bears a firm or business name that will indicate the ownership or identity of such vehicle while performing normal duties of loading or unloading as well as working in the meter zone, to park without paying a charge therefor. The duties of loading and unloading are to be performed as quickly as possible. The term "working in the meter zone" is applicable to any business firm which finds it necessary to use tools and equipment directly from said vehicle in the performance of its work. Such business firm or tradesman will be allowed to park said vehicle in the meter zone for such period of time as is found necessary to perform such job. However, it must be evident that the work being done requires that such vehicle remain in the meter zone and is necessary in the performance of said work.
B. 
It is also provided that business firms that have no means of loading or unloading from the rear of such business house, or business places that have loading or unloading zones that open onto meter zones shall apply to the Council for a permit to be granted to said business firm during business hours in order to reserve a space where such loading or unloading can be accomplished. Such permit is to be lettered RESERVED UNLOADING ZONE and shall be removed after store hours or holiday periods or such other times as said permit may not be found necessary.

A. 
Any person may purchase a City parking permit for a fee of $75 for a six-month period or $150 for a one-year period. Such permit shall be for the use of privately owned vehicles. Such permit shall allow parking in parking meter areas, except on Independence Street between Shamokin Street and Market Street, and except in nonparking zones, without charge; provided however, that parking in fifteen-minute meter areas with such permit shall not exceed 15 minutes in such area.
B. 
The permit, whose color may be changed as necessary, shall contain the following information.
(1) 
The printed words "Parking Permit" and "City of Shamokin, Pennsylvania."
(2) 
The permit holder's name and vehicle license number(s) for which the permit is to be used.
(3) 
The sequential number of the permit.
(4) 
The issue date and expiration date of the permit.
(5) 
The signature of the Mayor or other duly-authorized City official.
C. 
The City shall maintain a record of each permits issued pursuant to above provision, which shall include, at a minimum, the following:
(1) 
The permit holder's name, address and vehicle license number(s) for which the permit is to be used.
(2) 
The sequential number of the permit.
(3) 
The issue date and expiration date of the permit.
(4) 
The amount paid and the means of payment (cash, check number, etc.).
D. 
A permit issued pursuant to Subsection A hereof may also be used in any City parking lot which requires a permit for use, except that such permit may not be used in the Chestnut Street lot.
E. 
A special restricted parking permit for use solely in the nonmetered portion of the Third Street Parking Lot may be issued for a $50 fee for a one-year period. The issuance of said special parking permit shall be in the same manner as set forth in Subsections B and C above, except that the special restricted permit shall have clearly marked thereon the words "Third Street Parking Lot - Nonmetered Section Only."
F. 
A special restricted parking permit for use solely in the Chestnut Street Parking Lot may be issued for a $50 annual fee. The issuance of said special parking permit shall be in same manner as set forth in Subsections B and C above, except that the special restricted permit shall have clearly marked thereon the words "Chestnut Street Parking Lot Only." A maximum of eight permits for the Chestnut Street Parking Lot shall be in effect at any one time. The initial issuance of the permits shall be on a first-come-first-served basis until the maximum number of permits is issued. Existing permit holders shall have priority in renewing their permits, provided that the renewal fee is paid within 10 days following the expiration of the prior permit. Otherwise the expired permit can be issued to another person on a first-come-first-served basis.
G. 
When used in an authorized area, the parking permit (or special restricted parking permit) must be displayed prominently on the dash board or sun visor of the car so that the name of the permit holder, the permit number, the permitted vehicle license number, and the expiration date of the permit are plainly visible from the pavement to a passing police officer or meter clerk.
H. 
An above-described parking permit (or a special restricted parking permit) is issued solely for the use of the person(s) named on said permit and solely for the use of the motor vehicle(s) whose license number(s) appear on the permit. A maximum of two persons and two vehicles may be listed on a single permit. The permit may not be transferred from person to person or vehicle to vehicle.
I. 
After the effective date of this article, all twelve-month parking permits and/or special restricted parking permits will be issued with a beginning date of January 1 and an expiration date of December 31, and all six-month parking permits will be issued with either a beginning date of January 1 and an expiration date of June 30, or with a beginning date of July 1 and an expiration date of December 31. The prorata portion of the applicable fee will be charged so that the next renewal of the permit will be on the applicable day.
The proper officers of the City are hereby authorized and directed to enter into a contract for the leasing and installation of parking meters, said contract to be made subject to the conditions and in the manner provided by law, the payment of such meters and the installation thereof to be provided for solely from the receipts, funds and revenues obtained by the City from the operation of said parking meters, without in any manner obligating the City to pay for same from any other sources, and to enter into a contract or contracts for such parts and maintenance of such parking meters as may be necessary to maintain the same in good operating condition and to pay for such parts and maintenance exclusively from the receipts, funds and revenues received from the operation of said parking meters.
Nothing contained in this article or in any ordinance hereafter establishing parking meter zones shall be construed to permit parking of vehicles in those spaces within any zone in which, by other ordinances of the City, parking is prohibited. Until meters are actually installed in the parking zones hereinbefore described, the parking of cars in said zones or that part of the zone in which parking meters are not installed shall be limited to such parking time as has been fixed by other ordinances of the City.
If any section or provision, or part thereof, of this article shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the article as a whole or of any section, provision or part thereof not adjudged invalid or unconstitutional.
Sections 103-1 through 103-19, inclusive, of the Parking Meter Ordinance adopted August 13, 1946, as amended, are hereby repealed.
This article shall take effect immediately upon the passage thereof and advertisement thereof as required.
