Hereafter, every person or persons, firm or corporation, whether principal or agent, engaged in the merchandise business within the City of Shamokin who desires to conduct a fire, bankruptcy, closing-out or going-out-of-business sale or similar sale shall, before engaging in such sale, apply to the City Clerk and obtain from him a license so to carry on and conduct such sale.
Such sale shall not continue for more than 14 days, and no new or additional merchandise shall be added to the said stock after the date of the permit.
To obtain said permit, a complete inventory of the goods and wares to be sold at said sale must be submitted to the City Clerk, and, upon issuance of permit, it is then illegal to add to this stock and offer said merchandise for sale.
It is illegal to represent that the goods to be sold at said sale are being offered at reduced rates by reason of fire, wreck, bankruptcy, discontinuance of business, removal, etc., when said sales are not in fact bona fide and not as represented by said merchant or his agent or employee.

Any person, firm or corporation who shall violate or fail to comply with any of the provisions of this chapter shall, upon conviction thereof before any Magisterial District Judge, be sentenced to pay a fine of not less than $100 and not more than $300 and costs of prosecution and/or suffer imprisonment for up to 180 days, or both. The continuation of such violation for each successive day shall constitute a new and separate offense, and the person or persons allowing the continuation of the violation may be punished as provided above for each separate offense.
Each day's illegal sale shall constitute a separate offense.
The fee for a permit under this chapter is $25.
