From and after the passage of this article, there is hereby
established a curbstone market in the City of Shamokin, County of
Northumberland and State of Pennsylvania, on Tuesday, Thursday and
Saturday of each week during the year, the same to be held during
the hours prescribed by the City Council from time to time and, until
otherwise changed by the City Council, shall be between the hours
of 7:00 a.m. to 3:00 p.m., or as otherwise prescribed by Council.
The market shall be held on Independence Street along the south curb
thereof from Orange Street to Market Street, thence on Market Street
along the eastern curb thereof to Walnut Street. Whenever the regular
market day falls on a legal holiday, the market shall be held on the
day previous.
The vehicles shall be so placed along the curb as not to interfere
with public travel or with any street crossings and shall not be permitted
to occupy the street in any other position than by being backed up
against and at right angles to the curbstone or shall not occupy a
larger space or position thereof than the width of such vehicle. No
person attending market will be permitted to occupy or use a bench,
stand or otherwise more than three feet in width of the sidewalk measuring
from the curbstone. No person or persons shall be allowed to obstruct
or pass up or down the market sidewalks or pavements with any wheelbarrow,
cart or other conveyance with the object of selling therefrom during
the market hours.
No person shall sell or expose for sale in said market any live
animals, except poultry, game, small pigs and fish, nor shall any
beast be killed nor any meat or fish cured nor salted, nor shall poultry
or fish be cleaned, nor shall any pickle, garbage, rough fat, uncleaned
tripe, cattle feet or offal matter be laid, placed or thrown out in
the streets or the pavements.
It shall be the duty of the Supervisor to keep the streets clean
of all rubbage, refuse or any dirt left on them after market and,
in the winter, have the snow cleaned away and leveled so that wagons
or other vehicles can conveniently back up to the curb.
No person or persons attending market, having their stock or
any part thereof engaged or sold, shall be permitted to deliver the
same during market hours without first obtaining a permit from the
Market Clerk, giving the name of the party or parties to whom engaged
or sold.
The Town Council (now City Council) shall designate a person,
subject to dismissal at any time, to act as Clerk of the Market. He
shall be in constant attendance during market hours, shall keep full
and accurate records of the business entrusted to his care, keeping
a daybook to enter the date, name and amount paid to him by attendants
in market, and make report thereof to the Town Council (now City Council)
at its regular monthly meeting and pay over to the Borough (now City)
Treasurer all collections received by him. His accounts shall be audited
by the Borough (now City) Auditors in like manner as the accounts
of all other borough (now City) officers are by law required to be
audited. He shall have the general supervision over the market, mark
off or assign stations and collect fees and shall immediately notify
the Chief Burgess (now Mayor) of any violations of this article or
other rules of market. He shall receive such compensation as shall
be fixed by the Council. Said Clerk of the Market shall, before entering
in the duties of his office, enter into a bond with sufficient surety
in the sum of $300 for the benefit of the Borough of Shamokin (now
City), conditioned for the faithful performance of his duties.

Any person, firm or corporation who shall violate or fail to
comply with any of the provisions of this article shall, upon conviction
thereof before any Magisterial District Judge, be sentenced to pay
a fine of not less than $100 and not more than $300 and costs of prosecution
and/or suffer imprisonment for up to 180 days, or both. The continuation
of such violation for each successive day shall constitute a new and
separate offense, and the person or persons allowing the continuation
of the violation may be punished as provided above for each separate
offense.
All ordinances or parts of ordinances inconsistent herewith
be and the same are hereby repealed.

From and after the passage of this article, all farmers, vendors
and tradespeople attending the market commonly known as the "curbstone
market," in the Borough of Shamokin (now City), established by ordinance
approved the 11th day of July 1917, being an ordinance establishing
a curbstone market and providing for a suitable person to be Clerk
of the same, shall have the right and privilege to obtain and secure
a permanent stall or place to locate and station their respective
cars, trucks, vehicles, counters and other necessary equipment by
making the application, paying the fees and complying with the provisions
of this article.

The Chief Burgess (now Mayor) and Borough (now City) Engineer
shall designate and mark off spaces and sections of the width of nine
feet on the south side of Independence Street, from Market Street
to the western boundary line of the Reading Railroad right-of-way,
to be leased and rented by the Market Clerk to parties desiring such
space.

All parties leasing or renting one of said spaces or sections
shall pay to the City, for the use of the same and for the supervision
and reservation thereof, a rental or fee of $50 per year, to be paid
to the Market Clerk yearly in advance.

On all market days, the borough (now City) officials shall reserve
all spaces and sections leased and rented and shall keep the same
open and unoccupied for the lessee or party renting the same until
11:30 a.m.
All parties attending the Shamokin Borough (now City) curbstone market under and by virtue of the provisions of this article shall comply with all of the conditions, stipulations and provisions of Article
I of this chapter.
All other ordinances or parts of ordinances, insofar as the
same are inconsistent herewith, be and the same are hereby repealed.
