No "garbage storage container" (defined herein as a dumpster or other containing with the holding capacity in excess of 100 pounds) used for any legitimate reason shall be utilized on any street, sidewalk or other public right-of-way in the proximity of any residential or commercial property within the limits of the City of Shamokin, unless approved by the City Code Officer upon application as follows:
A. 
The applicant for a permit shall be the homeowner, but the owner of the garbage storage container must verify that a permit has been granted by the City of Shamokin to that specific number and address within the City.
B. 
The applicant for permit must first establish to the satisfaction of the City Code Officer that there is no viable alternative to the temporary use of the garbage storage container on any residential street or sidewalk or other public right-of-way in the proximity of any residential or commercial property.
C. 
Application for permit shall be filed with the City's Code Officer together with a fee of $25, per week, for a period not to exceed 30 days. At the conclusion of 30 days, the homeowner must reapply for a permit.
D. 
For the use of a garbage storage container in a metered zone, the fee shall be the maximum amount that the City of Shamokin would receive daily from each meter removed from utilization up to a maximum of 30 days plus $25, per week, as the usual permit fee. A separate fee shall be required for each garbage storage container.
E. 
All garbage storage containers must be identified by the owner of the premises and the owner of the garbage storage container with contact information included in a visible area of the garbage storage container.
F. 
The garbage storage container shall be maintained in a sanitary condition and covered at the conclusion of each work day; the exposed area of the container shall have reflectors or reflector tape attached and shall be secured in such fashion so as to protect the same from the public.
G. 
The garbage storage container shall be emptied promptly when full and at least once every week.
H. 
While in effect, the application shall act as a bar to any violations pertaining to snow removal, street cleaning or maintenance.[1]

I. 
The applicant shall be responsible for any damage to roadways, curbs or sidewalks or damages to property of or personal injury to another.

A. 
There shall be no garbage storage containers placed upon the railroad right-of-way within the City of Shamokin.
B. 
East Water Street from 8th Street to Rock Street in the City of Shamokin is exempt from this chapter.
C. 
No garbage storage container may be placed on State Route 61 or State Route 125.
D. 
The placement of the garbage storage container must be in an area approved by either the Code Officer of the City of Shamokin or the Street Department Foreman of the City of Shamokin.
E. 
A garbage storage container may be placed on private property as long as it is not on the sidewalk or right-of-way for pedestrians.
F. 
A garbage storage container may not be placed on private property if it is in an area that will obstruct the view of traffic.
G. 
The City of Shamokin has the legal right to have the commercial owner of the garbage storage container remove it if it is in violation of any section of this article.
All ordinances or parts of ordinances inconsistent herewith are expressly repealed.
This article shall take effect immediately after enactment.
Any person, firm or corporation who shall violate or fail to comply with any of the provisions of this article and who shall continue to violate or fail to comply with any such provisions 48 hours after receiving written notice of such violation by the City Codes Officer shall, upon conviction thereof before any Magisterial District Judge, be sentenced to pay a fine of not less than $100 and not more than $300, and costs of prosecution, and/or suffer imprisonment for up to 30 days, or both. The continuation of such violation for each successive day shall constitute a new and separate offense, and the person or persons allowing the continuation of the violation may be punished as provided above for each separate offense.
