This chapter shall be known and cited as the "House Trailers and Recreational Vehicles Ordinance."
A. 
This chapter is designed to control and restrict the parking and maintenance of nonmotorized house trailers, campers, boats or trailers used to carry boats, snowmobiles, motorcycles or like similar equipment, such as like off-road vehicles, including utility trailers, upon public streets or byways, sidewalks, City property, etc., in order to protect the public health, safety and convenience within the boundaries of the City of Shamokin.
B. 
The intent of this chapter is to limit the parking and maintenance of nonmotorized house trailers, campers, boats or trailers used to carry boats upon the City streets and/or sidewalks. The provisions of this chapter arise from the need to regulate and restrict and control the parking on the streets during winter months so that traffic and, in particular, fire or emergency vehicles can travel unexpected. It is not the intent that this chapter should change or amend Chapter 510, Zoning, and/or any other ordinances of the City of Shamokin or to unduly interfere with any state laws regulating the parking of the aforementioned vehicles.
It is hereby declared illegal for any person, firm, corporation or responsible party to place or maintain any nonmotorized house trailer, camper, boat or trailer used to carry boats or similar equipment, including utility trailers, upon the streets of the City of Shamokin or to block the sidewalk with the same from November 1 of each year through April 15 of each year in the City of Shamokin.
A. 
This chapter shall be enforced by the Shamokin City Police Department and any agency or officer the municipality may from time to time appoint. It shall be the duty of the aforementioned to investigate and prosecute any violations of this chapter.
B. 
If, after investigation, a violation is found to exist, the investigating officer shall prosecute a complaint before a Magisterial District Judge pursuant to the provisions of this chapter.
Any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 and not more than $300 and, in default of payment, to imprisonment of a term not to exceed 30 days.
This chapter is not intended to regulate the parking of motorized mobile homes, motorized motor homes or other similar motorized vehicles.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed.
If any sentence, clause, section or part of this chapter is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this chapter. It is hereby declared as the intent of the City of Shamokin that this chapter would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
This chapter shall become effective on July 15, 1992.
