[HISTORY: Adopted by the City Council of the City of Shamokin 7-14-1987 by Ord. No. 312 (Ch. 56 of the 1967 Code). Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
CONSPICUOUS LOCATION
Includes but is not limited to a front window or front door of a structure or other premises.
LIQUID OXYGEN
Refers to and includes oxygen in its liquid or gaseous state or in a combination of the two.

LIQUID OXYGEN PLACARD
A placard approved by the Shamokin City Council and available at the vendor's place of business and the Shamokin City Communications Center which announces the presence of stored liquid oxygen on the premises.
VENDEE
Any person or other entity who maintains liquid oxygen in any structure or premises located in the City of Shamokin.
VENDOR
Any person or other entity who sells or in any way distributes liquid oxygen for use in the City of Shamokin.
A. 
It shall be unlawful for any vendor to distribute liquid oxygen in any form for use within the City of Shamokin without first having placed in a conspicuous location a liquid oxygen placard on the structure or other premises where the liquid oxygen is kept.
B. 
The vendor and the vendee shall jointly have an affirmative duty to notify the Shamokin City Communications Center of the fact that liquid oxygen sold or distributed by the vendor has been installed in the structure or on the premises and, in that event, to have the liquid oxygen placard installed therein. Failure of the vendor to do so shall constitute a violation of this chapter.
C. 
The vendor and the vendee shall jointly have an affirmative duty to notify the Shamokin City Communications Center of the fact that liquid oxygen sold or distributed by the vendor has been removed from the structure or premises and, in that event, to have the liquid oxygen placard removed therefrom. Failure of the vendor to do so shall constitute a violation of this chapter.
D. 
It shall be unlawful for any vendee, person, firm, corporation or any other entity or agent therefor to keep liquid oxygen in any structure or other premises within the City of Shamokin without first having placed in a conspicuous location on said structure or premises a liquid oxygen placard.

Any person, firm or corporation who shall violate or fail to comply with any of the provisions of this chapter shall, upon conviction thereof before any Magisterial District Judge, be sentenced to pay a fine of not less than $100 and not more than $300, and costs of prosecution, and/or suffer imprisonment for up to 180 days, or both. The continuation of such violation for each successive day shall constitute a new and separate offense, and the person or persons allowing the continuation of the violation may be punished as provided above for each separate offense.
All other ordinances or parts of ordinances, insofar as the same are inconsistent herewith, be and the same are hereby repealed upon the effective date of this chapter.
The provisions of this chapter are severable, and if any section, clause, sentence, part or provision thereof is held to be illegal, unconstitutional or invalid, the decision so holding shall not affect or impair any of the remaining sections, clauses, sentences, parts or provisions of this chapter. It is hereby declared to be the intent of the Council of the City of Shamokin that this chapter would have been adopted as if such illegal, unconstitutional or invalid section, clause, sentence, part or provision had not been included therein.
This chapter shall become effective immediately upon passage by the City Council.
