This chapter shall be known as the "Housing Code" of the City and may be cited as such.

A. 
The purpose of this chapter is to provide minimum standards, provisions and requirements for the sanitary conditions which any habitable occupancy must provide for safe and healthful living. All housing built, prepared or remodeled within the corporate limits of the City shall conform to the requirements of this chapter and to the specifications, rules and regulations entitled the 2015 International Residential Code, issued by the International Code Council, approved and adopted by the City Council of the City, and which specifications, rules and regulations are hereby incorporated herein by reference and made a part of this chapter as if fully set forth herein. Copies of such specifications, rules and regulations shall be kept on file in the office of the City building inspector.
B. 
The following sections are hereby deleted from the International Residential Code in their entirety:
1. 
Section R313 Automatic Fire Sprinkler Systems.
2. 
Section R2904 Dwelling Unit Fire Sprinkler Systems.
C. 
The International Residential Code shall be enforced by the building inspector of the City of Tahlequah. The term "building official," wherever found in the International Residential Code, shall mean the building inspector of the City of Tahlequah.

This chapter shall not be construed as imposing upon the City any liability or responsibility for damages to any person injured by any defect in any house or other habitable dwelling mentioned herein. Nor shall the City or any official be held as assuming any such liability or responsibility by reason of the inspection authorized hereunder or by lack of such inspections.

Prior to start of construction, all lots or parcels of land platted or unplatted shall have all property lines, easements, rights-of-way, and building lines clearly marked by a registered land surveyor.

Concrete footings shall have a minimum of one no. 4 bar at the top and bottom of the footing. Bottom reinforcement shall be located a minimum of three inches clear from the bottom of the footing by using approved dobies.
Where a construction joint is created between a concrete footing and concrete or masonry stem wall, a minimum of one no. 4 bar shall be provided at not more than four feet on center. The vertical bar shall extend to three inches clear of the bottom of the footing, have a standard hook and extend a minimum of 14 inches into the stem wall.

Existing structures shall comply with the latest edition of the International Property Maintenance Code adopted by the City and all referenced codes that may apply.
