There is hereby created a schedule of fees and charges, which shall contain those fees and charges for the various licenses, permits and other fees and charges as designated by the City Council. Where a fee or charge is authorized to be collected by the City in any ordinance the amount of the fee or charge shall be set by resolution and entered into the schedule of fees and charges. The schedule shall be kept on file in the office of the City Clerk, to whom all fees and charges shall be paid unless otherwise provided. A copy of the schedule of fees and charges may be obtained upon payment of a fee as set forth in the schedule of fees and charges. The schedule of fees and charges hereby created shall also be known and may be cited the "fee schedule."

On an annual basis, the Mayor and/or City Administrator shall review the current Schedule of Regular Fees as part of the budget reconciliation process and may make recommended adjustments as deemed necessary and present said updated Schedule of Regular Fees to the City Council for consideration and/or approval by resolution.

The provisions of this chapter and the City's collection of the new and/or updated fees as expressed in the Schedule of Regular Fees referenced herein shall become effective on and after July 1, 2021, and remain in effect in perpetuity, or until lawfully repealed and/or altered.

All ordinances or parts hereof which are inconsistent with this chapter are repealed upon the effective date of this chapter.

The Tahlequah Fire Department shall initiate mitigation rates for the delivery of emergency and non-emergency services by the fire department for personnel, supplies and equipment to the scene of emergency and non-emergency incidents as listed in "EXHIBIT A". The mitigation rates shall be based on actual costs of the services and that which is usual, customary and reasonable (UCR) as shown in "EXHIBIT A", which may include any services, personnel, supplies, and equipment and with baselines established by addendum to this document.
A claim shall be filed to the responsible party(s) through their insurance carrier. In some circumstances, the responsible party(s) may be billed directly if self-insured.
The Tahlequah City Council may make rules or regulations and from time to time may amend, revoke, or add rules and regulations as it may deem necessary or expedient in respect to billing for these mitigation rates or the collection thereof.
The Mitigation Rates lists in "Exhibit A" will increase by 1.5% annually or based on the annual percentage increase in the Consumer Price Index (CPI), as developed by the Bureau of Labor Statistics of the U.S. Department of Labor, whichever is more. Rate adjustments will occur on the anniversary date of this Ordinance to keep the Tahlequah Fire Department's cost recovery program in conformity with increasing operating expenses.
