SECTION 1 CREATION OF HOSPITAL TRUST AUTHORITY.
In order to carry out the functions of public welfare in the City it is deemed necessary to accept the beneficial interest in the trust indenture dated the 3rd day of June, 1974 by the Tahlequah Chamber of Commerce, as trustor, and John Purdy, Mayor of the City of Tahlequah, Gilbert Bigby, Tracy Norwood, Dr. James Brixey and Herbert Rozelle, Councilmen of the City of Tahlequah, as trustees, offering the beneficial interest therein to the City. Beneficial interest in the trust is accepted and the same is hereby accepted by the council of the City. A copy of the trust indenture is on file in the office of the county Clerk. The trust indenture is hereby approved by the council of the City and by this ordinance and the benefits of the trust are hereby adopted for and on behalf of the City as the beneficiary thereof and the council of the City hereby accepts the beneficial interest therein conferred.
SECTION 2 SEPARABILITY.
If any section, sub-section, sentence, clause, phrase, or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance.
SECTION 3 REPEALER.
All ordinances and parts of ordinances in conflict herewith are hereby repealed.
SECTION 4 EMERGENCY.
It being immediately necessary for the preservation of the peace, health and safety of the City and the inhabitants thereof, the provisions of this ordinance shall take effect and be in full force from and after its passage as provided by law.
