A. To prevent the adverse impacts of stormwater runoff, the City of
Tahlequah has adopted a set of performance standards that must be
met at new development sites:
1. Maintenance After Construction: After construction is complete, the
owner or their agent shall take measures to apply and establish adequate
ground cover to ensure that the erosion on the site is stabilized
and not contributing to polluted runoff.
2. Inspections After Construction: After construction is complete, the
owner or their agent shall continue to regularly inspect the vegetation
until adequate turf establishment or other suitable vegetative cover
is established.
3. Drainage Control Facilities: Drainage control facilities such as
detention and retention ponds shall be maintained by the property
owner or by the designated property owners' association. When
any new drainage control facility is installed on private property,
or when any new connection is made between private property and a
public drainage control system, the property owner shall grant to
the City of Tahlequah the right to enter the property at reasonable
times and in a reasonable manner for the purpose of inspection. Failure
to maintain drainage facilities may result in abatement procedures,
if deemed a public nuisance.
