The 20 acre tract of land, reserved and set aside as shown by the plat of the City, certified to by C.E. Phillips, July 12, 1902, and approved by the secretary of the interior, March 4, 1904, shall be used as a cemetery for the burial of the dead, and no other purpose.

The cemetery dedicated in Section 14-401 of this chapter shall be known as Tahlequah cemetery.

A. 
Created. There is hereby created a board to be known as the Cemetery Board with the purpose of assisting with the general oversight of the Tahlequah City Cemetery and making recommendations to the City Council related to the same. Any previous boards created for this purpose under old ordinances are hereby disbanded and no longer have authority to act.
B. 
Composition; Appointment; Terms of Members. The Cemetery Board shall consist of five members who shall be appointed by the Mayor and confirmed by the City Council. One Cemetery Board member shall represent each of the four wards, with one member appointed at-large. The term of each member shall be four years, except for members on the first Board appointed, pursuant to this section. The first Board appointed pursuant to this section shall consist of one member who shall serve a one-year term; one member who shall serve a two-year term; one member who shall serve a three-year term and two members who shall serve a four-year term.
C. 
Compensation of Members. The members of the Cemetery Board shall serve without compensation, but may be paid for such reasonable expenses in performing their duties as may be allowed by the City Administrator.
D. 
Election of Officers. Each year in July, the Board shall elect a Chairperson, a Vice-Chairperson and a Secretary. The Chairperson shall preside at all meetings if absent, the Vice-Chairperson shall preside. The Secretary shall record the minutes of all meetings.
E. 
Meetings. The Cemetery Board shall determine the time and place of its regular meetings and shall meet not less than four times per year. The City Administrator, a majority of the City Council or any two members of the City's Cemetery Board may call a special meeting at any time.
F. 
Advisory Board. The Cemetery Board is an advisory board. As an advisory board, the Cemetery Board shall consult with the City Administrator on administrative affairs and the Mayor and City Council on matters of policy. The rules and regulations governing any and all cemeteries owned by the municipality shall be adopted by the City Council.

The cemetery superintendent shall have authority to close alleys in the cemetery from time to time as he may deem necessary.

No blocks shall hereafter be enclosed by stone, concrete, wire or picket fence, but shrubs or flowers may be used for marking off the blocks.

Any person who shall wilfully destroy any trees or shrubbery, or mutilate or deface any monument, fencing or other structure in the cemetery, or remove any landmarks, stakes or lot numbers, shall upon conviction be fined as provided in Section 1-108 of this Code.
