Every person owning property through which a watercourse passes shall keep and maintain that part of the watercourse within the property free of trash, debris, excessive vegetation, and other obstacles that may pollute, contaminate, or significantly retard the flow of water through the watercourse. In addition, the owner or lessee shall maintain existing privately owned structures within or adjacent to a watercourse, so that such structures will not become a hazard to the use, function, or physical integrity of the watercourse.

A. 
Vegetative Buffer: For all proposed development subsequent to the effective date hereof, there shall be a vegetative buffer of 50 feet of either side of any tributary for any property developed along an urban tributary in the City of Tahlequah, with the exception of land utilized for recreational purposes and other municipal improvements dedicated for public use.
B. 
Land Application of Chemicals: Pesticides, fertilizers, herbicides and biosolid composts, and any other chemicals that are land applied shall not be permitted for use in aquatic protection buffer zones in the City of Tahlequah. This measure is being taken to protect our streams from the pollutants associated with development and to provide adequate recharge area for stormwater runoff before it enters the streams.
C. 
Recording of Buffer: All plats prepared for recording and all right of way plats shall clearly:
1. 
Show the extent of any buffer on the subject property by metes and bounds.
2. 
Label the buffer zone.
3. 
Provide a reference to any protective covenants governing all buffer areas.
