A. 
No permit to operate or exhibit any circus or carnival within the City shall be issued until the applicant shall have filed with the City Clerk a copy of a public liability insurance policy, issued by an insurance carrier authorized to do business within the State, together with a certificate from the company stating that the policy is in full force and effect during the time the circus or carnival operates or remains within the City. In addition, the certificate of insurance or the policy shall name the City as a coinsured.
B. 
The insurance policy shall provide for full and complete liability coverage against loss imposed due to bodily injury or death of any person and injury to or destruction of property caused by operation of any circus or carnival. The minimum limits of coverage shall be not less than $300,000 for injury or death to any one person, not less than $1,000,000 for injury or death to two or more persons in any one incident, and not less than $100,000 for injury to or destruction of property in any one incident.

No person shall operate, exhibit or keep open any circus or carnival or any component part of any circus or carnival between the hours of 11:00 p.m. of each day and 8:00 a.m. the next succeeding day.

All power lines or wires used to deliver electricity to a circus or carnival shall be buried underground no less than six inches deep; or in the alternative power lines placed on the ground shall be covered With "electrical duct" or similar rubberized material which will permit the passage of foot or vehicular traffic over the wires.

A. 
Prior to the issuance of a permit to operate a circus or carnival, the applicant shall deposit, in cash only, with the Finance Director of the City a cash bond in the sum of $1,000. The cash bond shall be conditioned upon the applicant's full and faithful compliance with all the provisions of this chapter and this Code. In addition, the cash bond shall be further conditioned that the applicant's operation will cause no damage to be done to the streets, sewers, waterlines, trees or any other public or private property; and that no dirt, trash, paper, litter or other debris will be permitted to remain upon the streets or any private property by such applicant.
B. 
Upon the joint certification of the Chief of Police and the City Inspector that all conditions of such bond have been complied with, the cash bond shall be returned to the permit holder. In the event the City's employees are required to clean up or remove debris and trash from the premises used by the permit holder, the cash bond shall be deemed forfeited and become the property of the City.

No permit shall be issued for any carnival game or concession booth, operating individually or as a component part of any circus or carnival, where the game rewards the successful player with cash, or tokens or coupons that are redeemable in cash.

A. 
Adequate toilets shall be provided for patrons and employees. The owner or operator of any carnival or circus shall provide, at his sole expense, adequate toilet or portable toilet facilities for his employees and the general public. Such toilets shall not be less than 100 feet from the place where food is prepared or offered for sale and shall be constructed to prevent surface drainage of body fluids. Toilets shall be flyproofed or treated with disinfectants and fly repellents; toilets shall be sterilized and covered with earth when abandoned.
B. 
Adequate trash containers shall be provided, at the expense of the owner or operator, for the disposal of trash, litter, paper and other debris.
C. 
The Health Officer shall be responsible for determining whether the requirement of this Section has been met by the applicant. The Health Officer shall determine the quantity of toilet and trash facilities, and the owner or operator of the circus or carnival shall provide the quantity as directed by the Health Officer.
