This chapter shall be known as the "Building Code of the City
of Tahlequah" and may be cited as such.

A. A certain document, one copy of which is on file in the office of the City building inspector, being marked and designated as the 2015 International Building Code as published by the International Code Council, be and is hereby adopted as the Building Code of the Code of Ordinances of the City of Tahlequah in the State of Oklahoma; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Building Code, are hereby referred to, adopted and made a part hereof as if fully set out in this section, with the additions, insertions, deletions and changes, if any, prescribed in Section
5-102.1 of this chapter.
B. The International Building Code shall be enforced by the building
inspector of the City of Tahlequah. The term "building official,"
wherever found in the International Building Code, shall mean the
building inspector of the City of Tahlequah.

Additions, insertions and changes to the Building Code shall
be as made by the City from time to time.

No permits shall be valid until such fees as are established
from time to time by the City shall have been paid; nor shall an amendment
to a permit be approved until the additional fees, if any, shall have
been paid.

A. Construction documents shall be prepared by a registered design professional
and submitted with the building permit application for the following:
1. One- and two-family dwellings exceeding 4,000 square feet.
2. Multi-family dwellings over two stories in height or that exceed
5,000 total square feet.
3. All construction requiring a building permit according to the International
Building Code and International Existing Building Code currently adopted
by the City of Tahlequah in excess of 4,000 square feet or exceeding
three tenant spaces.
B. All construction documents may be subject to the State Fire Marshal's
approval.

Prior to start of construction all lots or parcels of land platted
or unplatted shall have all property lines, easements, rights-of-way,
and building lines clearly marked by a registered land surveyor.

This chapter shall not be construed as imposing upon the City
any liability or responsibility for damages to any person injured
by any defect in any new construction, repair, remodeling or maintenance
of any structure or building mentioned herein, nor shall the City
be held as assuming any such liability or responsibility by reason
of the inspection authorized hereunder of the certificate of approval
issued by the inspector.

Any inspection which is not part of the normal inspection requirements
such as, but not limited to, evening, weekend or holiday inspection,
building sprinkler systems inspections, and consultation inspections.

The fee for all such special inspections shall be figured at
a rate of $0.01 per the structure's total square footage, with a minimum
of $50 per inspection.

C of this section.

by the building inspector of the City of Tahlequah. The term "code
official," wherever found in the International Existing Building Code,
shall mean the building inspector of the City of Tahlequah.
C. Additions, Insertions And Changes: Additions, insertions and changes
to the Existing Building Code shall be as made by the City from time
to time.

A certain document, one copy of which is on file in the office of the City building inspector, being marked and designated as the 2015 International Property Maintenance Code as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Code of Ordinances of the City of Tahlequah in the State of Oklahoma; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code, are hereby referred to, adopted and made a part hereof as if fully set out in this section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection
C of this section.
B. Enforcement. The International Property Maintenance Code shall be
enforced by the building inspector of the City of Tahlequah. The term
"code official," wherever found in the International Property Maintenance
Code, shall mean the building inspector of the City of Tahlequah.
C. Additions, Insertions and Changes. Additions, insertions and changes
to the Property Maintenance Code shall be as made by the City from
time to time.

A. No person, firm or corporation shall construct, enlarge, alter, repair,
move, or demolish a building or structure within the City of Tahlequah
for which a permit is required unless said person, firm or corporation
has been issued a City building contractor's license and which license
is in effect at the time a permit is issued.
B. Upon proof of a certificate of insurance from the appropriate insurer
that the building contractor has general liability insurance in an
amount of $50,000 or more and that the contractor has workers' compensation
insurance or a workers' compensation exemption verification document,
a building contractor desiring to do such work shall secure from the
City Clerk a nontransferable license which shall run until June 30
next succeeding its issuance, unless sooner revoked. The City of Tahlequah
shall not be liable if the documentation provided is false or if the
general liability insurance or workers' compensation insurance lapses.
C. The fee for a building contractor's license shall be $300 initially
with a renewal fee of $50 annually. No license fee shall be prorated.
Such license shall expire on June 30 next following its issuance.
D. The annual license issued pursuant to this section shall be for the
period July 1 to June 30 of the succeeding year.
E. Nothing herein contained shall be construed as prohibiting an individual
from performing the construction or remodeling to his or her own residence
or as requiring an individual to have a license to do the construction
or remodeling on his or her own residence. However, all such work
must be done in conformity with all other provisions of this chapter,
including those relating to permits, inspections, and fees.

A. After adequate opportunity for a hearing, the City council may revoke
the license of a building contractor for any of the following causes:
1. Serious or repeated violations of the laws, ordinances, or other
regulations relating to building construction;
2. Grossly unethical conduct in connection with the building trade or
business;
3. Poor workmanship or service; or
4. Installing inferior or substandard materials, fixtures, or equipment.
B. A request that the license be revoked may be presented to the council
by the building inspector or by any aggrieved person.
