A. The purpose of this section is to establish rules for enclosed dumpster
areas in order to:
1. Prevent accumulations of garbage and rubbish from spreading throughout
the City and endangering the health of citizens.
2. Enhance the aesthetic appearance of the community.
B. For the purposes stated in Subsection
A of this section:
DUMPSTER
Any portable container used or designed for collection of,
transportation of, or disposal of refuse, waste, or the like. Refuse
dumpster shall include, but is not limited to, "roll-off" boxes or
containers, collection bins, tubs, and portable storage containers
capable of containing more than 96 gallons of material, but shall
not include those containers placed for less than 60 days or that
are intended to hold construction or demolition materials.
FOOD SERVICE ESTABLISHMENTS
Any establishment preparing, handling, and serving food to
the public, which requires the installation of a grease interceptor
(grease trap) as per part 5, Chapter 2 of this Code.

A. Existing dumpsters which, in the judgment of the compliance officer,
do not meet the intent of this chapter shall be removed or shall have
the following improvements to be made on or before December 31, 2014.
B. Dumpsters must be enclosed or screened sufficiently to prevent the
dumpster from being visible from:
1. A City street or other ROW.
2. A residence (regardless of zoning).
C. Screening shall be accomplished through one of the following methods:
2. Partial dumpster enclosure.
3. Six foot opaque fence located at property line.
4. Six foot opaque fence located between the dumpster and the viewer's
location.
5. Year round landscaping (evergreen/coniferous) maintained to a minimum
height of six feet.
6. Any combination of the above.
D. Dumpsters that, in the judgment of the compliance officer, cannot
be made to fit the requirements of this section due to space restrictions
or for reasons of public safety shall be exempted from the requirements
of this section, under the following conditions:
1. If space exists for partial compliance, then the compliance officer
shall cause the dumpster to comply with the requirements for which
space is available.
2. The compliance officer provides written verification of the type
and extent of the exemption(s) to the dumpster owner and the reason
for the exemption.

A. The requirements of this section are not intended to apply to dumpsters
that were placed within the City prior to the date of adoption hereof
and enclosed in a manner that meets the general intent of this section.
B. All dumpsters placed within the City on or after the date of adoption
hereof shall meet the following requirements:
1. All properties that utilize a dumpster shall also provide an enclosed
dumpster area.
2. All dumpster enclosures shall be placed on a concrete pad with a
concrete apron.
3. Food service establishments must cause the required concrete pad
to drain into the sanitary sewer system, but be designed to prevent
the infiltration of stormwater in the sewer system.
4. Food service establishments must route dumpster pad drains through
grease control equipment first, then to the sanitary sewer.
C. All dumpster enclosures shall be located behind the front building
line or behind the front corner of the primary structure, whichever
is the greater distance from the front property line. If the topography
or other conditions will not allow the dumpster enclosure to meet
this requirement, the planning and zoning commission shall designate
an appropriate location.
D. Dumpsters shall be surrounded by an opaque enclosure that is compatible
with the design and color of the principal building. Chainlink fence
shall not be permitted as an enclosure.
E. Dumpster enclosures shall have a minimum height of six feet. If the
dumpster is taller than four feet, the enclosure shall be two feet
taller in height than the dumpster.
F. Dumpster enclosures shall not be located on any required parking
spaces.
G. Dumpster enclosures shall not be located within any required buffers
or easements.

A. All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of the conflict.
B. The provisions of this chapter are hereby declared to be severable
and if any section, phrase or provision shall be declared or held
invalid, such invalidity shall not affect the remainder of the sections,
phrases or provisions.
