As used in this chapter, the following terms and words shall
mean:
AMUSEMENT RIDE
Any mechanical or electrical device or structure by which
persons are conveyed or moved about for diversion or amusement. The
term "amusement ride" shall include, but shall not be limited to,
the following:
I.
Whirligig;
or other rides or conveyances of like kind or character, whether
fixed or mobile. The operation or maintenance of more than three amusement
rides shall be deemed a "carnival," and the operation shall comply
with all provisions of this chapter relating to carnivals.

CARNIVAL
An amusement show, operated on an infrequent basis at a temporary
location, which offers public entertainment by featuring carnival
games or more than three amusement rides, or both such games and rides.
The term carnival shall not include operation of school and church
carnivals, provided that:
A.
The carnival games must be owned and operated solely by the
school or church, or the students or patrons thereof; and
B.
That the proceeds derived from the school or church carnival
must exclusively benefit the school or church, or the official programs
thereof;
CARNIVAL GAMES
Any form of play, contest or amusement, usually necessitating
the exercise of skill or physical dexterity on the participant's
part, which generally requires the payment of money, or its equivalent,
in order to participate and often offers a reward or prize for the
attainment of a goal or the successful completion of an assigned task.
The term "carnival game" shall include, but not be limited to, the
following:
I.
Strength or skill machines;
K.
Throwing or propelling any object at any target;
N.
Wheels of fortune; or anything of a similar nature.
CIRCUS
Traveling company or troupe that presents public entertainment
which features exhibits of pageantry and performances by acrobats,
aerialists, clowns and trained animals. In addition, the term "circus"
shall include the exhibition of menageries, curiosities and monstrosities.
CONCESSION BOOTH
The area or space which contains an individual carnival game,
regardless of whether the same is a part of a larger structure or
a wheeled vehicle.
