Editor's Note: Ord. 6 S+FS, 8-3-1994 created the Department of Water and Sewer Utilities. The Division of Billing and Customer Service (previously in the Department of Finance) and the Division of Sewers and Water Supply (previously in the Department of Engineering), and self-liquidating sewer utility in accordance with N.J.S. 40A:2-45 is hereby established.

a. 
Divisions. There shall be a Department of Water and Sewer Utilities, the head of which shall be the Director of Water and Sewer Utilities. The Department shall consist of the following Divisions:
Billing and Customer Services; and Sewers and Water Supply.
b. 
Qualifications of Director. The Director of Water and Sewer Utilities shall, prior to appointment, be qualified by education, training and/or experience, in the planning and execution of water and sewer public works operations and improvements and possess the knowledge and ability to direct and supervise revenue accounting and collection operations. The Director's compensation shall be such sum annually as shall be fixed by ordinance of the Municipal Council.
c. 
Duties of the Department. The Director, through the Divisions and otherwise, shall direct and supervise the functions and activities for the design, condition and performance of the City's water, sanitary and storm sewerage systems and develop and maintain methods to account for water consumption and usage and the implementation of revenue collection systems related thereto in order to maintain the self-liquidating requirements of both the water and sewer utilities. Additionally, the Director of Water/Sewer Utilities, himself, or through a nominee shall authorize, direct and supervise the preparation of plans, specifications, and the letting and performance of all service, professional, and construction contracts under the Department of Water and Sewer Utilities.

Water and sewer rates in the City of Newark shall be established by ordinances of the Municipal Council.

In accordance with N.J.S. 40A:2-45, a self-liquidating sewer utility is hereby established and as such the general obligation debt heretofore authorized and/or issued for sewer purposes becomes a debt of the sewer utility.

There shall be within the Department of Water Utilities, a Division of Billing and Customer Service the head of which shall be the Manager of Water Billing and Customer Service.

The Division of Billing and Customer Service, under the supervision of the Director of Water and Sewer Utilities shall be responsible for the reading of water meters, billing, accounting for water consumption and wastewater charges at the rates and charges as provided by ordinance, the repair, maintenance and proper functioning of water meters at the owner's expense and the receiving of and adjustment, if necessary, of complaints arising from charges resulting from water usage and sewer discharge and treatment.

There shall be within the Department of Water and Sewer Utilities, a Division of Sewers and Water Supply the head of which shall be the Manager of Sewers and Water Supply.

a. 
The Division of Sewers and Water Supply, under the direction of the Director of Water and Sewer Utilities, shall manage, administer, operate, maintain, improve and extend the lands, reservoirs, aqueducts, distribution mains, hydrants, valves and other structures, facilities and appurtenances of the water works owned by the City for supplying the Division customers within and outside of the limits of the City; and through the North Jersey District Water Supply Commission or otherwise, as required or permitted by statute, shall cooperate with others in providing additional water supply for Newark's needs and those of others dependent on Newark for water supply.
b. 
The Division of Sewers and Water Supply shall also construct, operate and maintain the City's sanitary and storm sewerage system, and administer the City's ordinance relating to sewers and drains and shall also be responsible for the treatment of wastewater and stormwater through its contracts with the treatment entities — Passaic Valley Sewerage Commission and Essex and Union Joint Meeting.
c. 
In lieu of the planning, conservation, development and management of the City's Pequannock Watershed properties by regular City department, the City of Newark may enter into one or more service agreement for any or all those purposes. In the event that any such agreement becomes operative, the department shall coordinate the administration of the agreement with the other water supply functions of the Division and the Director of Water and Sewer Utilities shall supervise the administration of the agreement on behalf of the City of Newark.
d. 
The Division of Sewers and Water Supply shall be under the supervision of a Manager, Division of Sewers and Water Supply.
e. 
All of those duties and responsibilities previously assigned to the Division of Water Accounting and Customer Service within the Department of Finance and to the Division of Water/Sewer Utility within the Department of Engineering are now assigned to the Divisions of Billing and Customer Service and Sewers and Water Supply respectively in the Department of Water and Sewer Utilities.
