MULTI-UNIT DWELLING
Shall mean and include any privately-owned building or structure and land appurtenant thereto containing four or more apartments that are rented or offered for rent to three or more tenants or family units when the fourth unit is occupied by the owner.
OWNER
Shall mean the owner, lessee, agent or other person who manages or controls any rented multi-unit dwelling.
TAP AFFIDAVIT
Shall mean the document which is required to be completed in order for the owner of a multiple unit dwelling to participate in the TAP Program.

Any owner of a multi-unit dwelling may submit a TAP Affidavit to the Newark Division of Police. By completing the TAP Affidavit and all necessary supporting documents, the owner is authorizing and granting access to the Newark Division of Police to the common areas of the property in order to enforce the laws of the City of Newark and the State of New Jersey, including but not limited to N.J.S.A. 2C:18-3 et seq., "Criminal Trespass." The owner of the multi-unit dwelling who has submitted a TAP Affidavit is required to obtain and pay for a minimum of two signs and two registration stickers which are to be posted in a conspicuous manner and shall alert individuals at the major points of ingress and egress of the location's participation in the TAP Program and further notify all persons on the property that trespassers may be subject to arrest. By executing the TAP Affidavit, the owner, his/her agent and/or his/her assigns, agree to cooperate with the Newark Division of Police and all other requisite law enforcement agencies in prosecuting any individuals arrested and charged pursuant to the TAP Program.

a. 
A TAP Affidavit may be obtained from any Newark Division of Police precinct. A TAP Affidavit must be completed for each multi-unit dwelling that wishes to participate in the program.
b. 
Each TAP Affidavit must be submitted with proof of ownership of the multi-unit dwelling which must substantiate that the affiant is the owner of record of the premises or that the affiant has been duly authorized by the owner of record of the premises to sign on his/her behalf. If the owner of the multi-unit dwelling is a corporation, the affiant must provide the requisite documentation indicating that the corporation has authorized the affiant to execute the affidavit on behalf of the corporation.
c. 
All completed TAP Affidavits shall be submitted to the Newark Division of Police with the appropriate payment for the required signage and registration stickers, and any additional signage or registration stickers requested by the affiant, to the respective Newark Division of Police precinct for each intended TAP location.
d. 
All completed TAP Affidavits and supporting documentation shall be reviewed by the City.
e. 
Once approved, the City shall advise the affiant in writing that the application has been approved and shall further advise that the affiant must return to the proper precinct to retrieve a copy of the fully executed TAP Affidavit and the appropriate signage.
f. 
Fully executed TAP Affidavits shall be maintained by the Newark Division of Police.

a. 
All owners shall purchase, at their own expense, a minimum of two signs and a minimum of two registration stickers for each multi-unit dwelling participating in the TAP Program and must post each sign with the registration stickers affixed thereto within 10 days from the date of receipt of same.
b. 
The signage shall be posted in a conspicuous manner at the major points of ingress and egress and at a height suitable for preventing tempering and damage.
c. 
Additional signs and registration stickers may be purchased upon confirmation from the Newark Division of Police that the multi-unit dwelling designated for each sign is currently participating in the TAP Program and upon payment of the fee for each additional sign requested.

a. 
The fully executed TAP Affidavit shall only be valid for a term not to exceed 12 months. All affidavits shall terminate on December 31st of the year in which they are executed, regardless of the month in which the affidavit is executed and filed.
b. 
At the end of the one-year term, the affiant will have 30 days from the date of expiration to renew the affidavit while still remaining in the TAP Program. Renewal of the affidavit requires that the affiant submit a new TAP Affidavit with the same proofs as set forth in N.R.O. 20:29-3. If the TAP Affidavit is not renewed within the thirty-day period of time, the named multi-unit dwelling will cease to be subject to the TAP Program.
c. 
Upon renewal, the owner shall purchase registration stickers from the Newark Division of Police for the number of signs posted at each participating TAP site and affix same to the signage, indicating current participation in the program. Said registration stickers shall be affixed to the requisite signage within 30 days of issuance.

All signage must be returned to the Newark Division of Police within 30 days after the expiration of the affidavit in the event that the affidavit is not renewed.

a. 
Any affiant who fails to remove and return any signage when affiant's participation in the TAP Program ceases may be punished by a fine not exceeding $500. Each day in which the matter is not abated shall constitute a separate offense.
b. 
Any owner who has executed a TAP Affidavit and fails to cooperate with the Newark Division of Police or other requisite law enforcement agencies in prosecuting individuals arrested and charged pursuant to the TAP Program shall be subject to a fine not exceeding $1,000.
c. 
Any owner who fails to update information contained on the TAP Affidavit within 10 days of learning that a change in the information has occurred shall be subject to a fine not exceeding $250. Each day in which the matter is not abated shall constitute a separate offense.
d. 
Any owner who utilizes signage not specifically issued to his/her multi-unit dwelling or who uses false signage purporting to be produced by the City of Newark pursuant to the TAP Program may be punished by a fine not exceeding $500. Each day in which the matter is not abated shall constitute a separate offense.
