As used in this chapter, unless the context indicates otherwise:
DAIRY
Shall mean any place or building where one or more cows are kept, a part or all of the milk, cream or milk products from which is sold or delivered to any person; also, any place known as a creamery, shipping station or pasteurizing plant where milk, cream or milk products are held for sale, processed, sold, stored or distributed.

There is hereby created a fund to be known as the "Special Dairy Inspection Fund Account."

The aforesaid special fund shall consist of monies in such amounts as hereinafter specified, contributed to the fund by the owners or operators of each dairy establishment, whose dairy establishment is inspected by the duly authorized inspectors and employees of the Department of Health and Community Wellness of the City.

All monies contributed to the aforesaid fund shall be received by the City Treasurer and deposited by him/her in the trust account.

The owner or operator of each dairy to be inspected shall deposit, or cause to be deposited, with the City Treasurer a sum of not less than $300 as an initial deposit, and shall make additional deposits from time to time when requested by the City Treasurer, so that there may be available sufficient funds to cover the expenses incurred in making the required inspections of each dairy. The minimum balance in each deposit shall be not less than $50.

There shall be paid from the fund the necessary expenses incurred by the Inspector or employee delegated to make the inspection. These expenses shall be charged against the owner or operator of the dairy that is inspected.

The aforesaid necessary expenses shall be disbursed by the City Treasurer upon proper authorization by the Health Officer of the City.

The accounting of the fund shall be made by the Comptroller, who shall set up in the general ledger a special captioned account to be designated, "Special Dairy Inspection Fund Account."
