No person shall create, construct or enlarge any areaway which
shall extend beyond the building line into the street without first
obtaining the written permission of the Director or his authorized
representative.

No permit shall be granted except for construction approved
by the Construction Official, which shall in any case include a substantial
approved grating of metal, flush with the sidewalk. No permit shall
be granted for the creation, construction or enlargement of any uncovered
areaway.

No permit shall be granted until there shall first be paid to the City a deposit as required by Section
29:5-2 of this Title, and fee of $35 for such areaway to be created, constructed or enlarged.

No areaway referred to in Section
29:8-1 shall extend beyond the building line into the street more than 1/3 of the width of the sidewalk, nor more than four feet in any case whatsoever.

No person shall continue or suffer or permit to remain any covered
or uncovered areaway occupying any portion of a public sidewalk that
is dangerous to the travelling public using such sidewalk, or that
violates any provision of this Title or regulations of the Director
supplementary thereto.

Whenever the removal of any areaway shall become necessary because
of public improvement or public utility construction, the person maintaining
such areaway or owning, leasing or occupying the property of which
such areaway is a part, shall, upon 30 days' notice from the
Director or his authorized representative, remove such areaway and
restore the earth, pavement or other sidewalk surface to its proper
condition.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished as provided in Section
1:1-9 of these Revised General Ordinances, in addition to paying the cost of restoring to its proper condition any sidewalk surface disturbed by such violation.
