a. 
Solid Waste Refuse and Trash. No persons shall dump, deposit or leave any solid waste material or debris on City property except in proper receptacles provided therefor. Any person found guilty of dumping solid waste materials, shall be subject to a fine of not more than $1,000 plus the cost of removal of debris and rehabilitation of the land. Solid waste shall include garbage, refuse and other discarded materials resulting from industrial, commercial, domestic and community activities, and shall include all other waste materials including liquids and landfills.
b. 
Glass Beverage Containers. Use or possession of glass beverage containers is hereby prohibited within the confines of all City property.
c. 
Picnics. No person shall leave a picnic area before all trash in the nature of boxes, papers, cans, bottles, garbage and other refuse is placed in disposal receptacles where provided. If no such trash receptacles are available, then refuse and trash shall be carried away from the park area by the picnicker to be properly disposed of elsewhere.
d. 
Camping. No person in a park shall set up tents, shacks or any other temporary shelter for the purpose of overnight camping, nor shall any person leave in a park after closing hours any movable structure or special vehicle to be used or that could be used for such purpose, such as house trailer, camp trailer or the like.
e. 
Intoxicating Beverages. No person shall bring in, possess or consume any beer or alcoholic beverages at any time except where designated by the Director of the Department of Recreation, Cultural Affairs and Senior Services.
f. 
Dogs and Domestic Animals. Except for seeing eye dogs, dogs or any domestic animals are not permitted on courts or play field areas at any time. The Director of the Department of Recreation, Cultural Affairs and Senior Services may prohibit dogs entirely in other designated areas. Dogs are not permitted except when held by leash and under control of the owner or the person having such dog in charge. No dog or domestic animal shall be permitted to be at large and any owner or person in charge of such animal shall be responsible for the control thereof. Any owner or person in charge of any dog shall immediately remove all feces deposited by any dog on City property and dispose of it in a sanitary manner.
g. 
Feed shall mean to give, place, expose, deposit, distribute, or scatter any edible material with the intention of feeding, attracting, or enticing wildlife. Feeding does not include baiting in the legal taking of fish and/or game.
h. 
Fires. No person shall build or attempt to build a fire. No person shall drop, throw or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco paper or other flammable material, within any City park.
i. 
Exhibit Permits. No person shall fail to produce and exhibit any permit from the Director of the Department of Recreation, Cultural Affairs and Senior Services he/she claims to have upon request of any authorized person who desires to inspect same for the purpose of enforcing compliance with any ordinance or rule.
j. 
Vending and Peddling. No person shall expose or offer for sale any article or thing, nor shall be/she station or place any stand, cart or vehicle for the transportation, sale or display of any such article or thing, except under the authority and regulations of the Director of the Department of Recreation, Cultural Affairs and Senior Services.
k. 
Signs. No person shall paste, glue, tack or otherwise post any sign, placard, advertisement or inscription whatsoever, without authorization from the Director the Department of Recreation, Cultural Affairs and Senior Services.
l. 
Hours of Operation. Except for unusual and unforeseen emergencies, City parks shall be open to the public every day of the year during designated hours. The opening and closing hours shall be posted therein for public information. No person shall be in any City park before daybreak or after 9:00 p.m., except as provided by the Director of the Department of Recreation, Cultural Affairs and Senior Services. This restriction shall not affect the right of the public to use the pathways in and through public grounds for the purpose of travel.
m. 
Permit Issuance and Exemption. All permits and special permission for exemption from any rules and regulations as set forth herein shall be issued by the Director upon the approval of the Municipal Council by a resolution granting same. All permits and special permission shall be either printed matter or written and signed by the Director.
n. 
Wildlife feeding. No person shall feed, in any public park or on any other property owned and operated by the City of Newark, any wildlife, excluding confined wildlife (for example, wildlife confined in zoos, parks, or rehabilitation center, or unconfined wildlife at environmental education centers).

The purpose of this section is to establish regulations for the safe use of the skate park located within Jesse Allen Park in the City of Newark.

a. 
SKATE PARK — Shall mean that portion of Jesse Allen Park wherein a facility has been constructed for public skating and skateboarding along with the area of public property within the immediate vicinity of said facility.
b. 
ROLLER SKATES — Shall mean a pair of devices worn on the feet with a set of wheels attached, regardless of the number or placement of those wheels, and used to glide or propel the user over the ground. This definition is intended to also include any vehicle commonly referred to as "rollerblades."
c. 
SKATEBOARD — Shall mean a vehicle consisting of material or a portion of material formed into a thin firm sheet with wheels attached to the underside intended and designed to be propelled by a foot.
d. 
BICYCLE — Shall mean a vehicle most commonly having two wheels propelled solely by human power and having pedals, handle bars and a saddle-like seat.

a. 
Skateboarding and/or roller skating at a skate park facility are known hazardous recreational activities for users and participants.
b. 
The City of Newark shall not be liable for injuries incurred by persons participating in skateboarding and/or roller skating, which are hazardous recreational activities, at the Skate Park.

a. 
The skate park shall be unsupervised at all time. Persons shall use the skate park at their own risk of injury to themselves and others. Users and participants shall be deemed to have intentionally and voluntarily released the City of Newark, its agents, officers, and employees from any liability for damage or injury to person or property.

a. 
Skateboards and Roller Skates Only. Only skateboards and/or roller skates are permitted to be used or operated in the skate park. Bicycles, motorcycles, scooters and any other wheeled device are specifically prohibited.
b. 
Hours of Operation. The skate park shall be open for use during the normal, posted hours of operation for Jesse Allen Park, except as otherwise permitted by the Business Administrator or the Director of the Department of Recreation, Cultural Affairs and Senior Services.
c. 
Required Equipment. All participants, regardless of age, must wear at all times properly fitted and fastened helmets, elbow pads, and knee pads.
d. 
Helmet Requirements for Persons under the Age of 17. Pursuant to N.J.S.A. 39:4-10.5, persons under 17 years of age shall wear at all times a properly fitted and fastened helmet which meets the standards of the American National Standards Institute (ANSI Z90.4 bicycle helmet standard), the Snell Memorial Foundation's 1990 Standard for Protective Headgear for use in Bicycling, the American Society for Testing and Materials (ASTM) standard, or other such standard, as appropriate. Parents or legal guardians shall be held liable for any penalty assessable to their minor children or wards.
e. 
Age Requirements. Persons must be at least seven years old to utilize the skate park.

a. 
Bicycles, motorcycles, scooters, and any other wheeled devices and/or any type of motorized vehicles are not permitted to be used in the skate park.
b. 
Personal ramps, boxes, or other skate elements are not permitted inside the skate park.
c. 
Pets and animals, with exception of service animals, are not permitted inside the skate park.
d. 
Food and/or beverages are not permitted inside the skate park.
e. 
No persons, other than users and participants, shall be permitted inside the skate park.
f. 
No persons shall utilize the skate park in a manner other than for which the skate park was designed to be used.
g. 
No person shall damage, deface, litter, or otherwise alter the appearance of the skate park or any property or facilities therein.
h. 
No person shall use the skate park in a manner which is unsafe, physically intimidating, which places others at risk of physical harm, or which interferes unreasonably with the safe and enjoyable use of others.

a. 
A violation of subsection 20:20-2.5d of this section shall be subject to the assessment of penalties in accordance with N.J.S.A. 39:4-10.6.
b. 
A violation of any other provision of this section shall be punishable by (a) the issuance of a warning for a first offense; and (b) a fine not to exceed $25 for the second offense or a period of community service not to exceed five days; and (c) a fine not to exceed $100 for each subsequent offense and/or a period of community service not to exceed 30 days. The City waives the application of the additional penalty for a subsequent violation within one year of a previous violation pursuant to N.J.S.A. 40:49-5.
c. 
A violation of any provision of this section shall also be punishable by revocation of the use of the skate park.
