As used in this chapter:
BUSINESS ADMINISTRATOR
Shall mean the Business Administrator of the City of Newark.
COMPANY STAND
Shall mean a public place alongside the curb of a street or elsewhere in the City which place the Manager, Office of Taxicabs, has authorized a holder of taxicab licenses to use exclusively for the dispatching of company taxicabs.
CRUISING
Shall mean the driving of a taxicab on the streets or public places of the City in search of or soliciting prospective passengers for hire.
DRIVER'S LICENSE
Shall mean the permission granted by the Manager, Office of Taxicabs to a person to drive a taxicab upon the streets of the City.
GROUP RIDING
Shall mean the transporting of two or more passengers as permitted by Section 34:1-59.
HEARING
Shall mean a public hearing at which the licensee shall be given an opportunity to appear personally and be represented by his/her chosen counsel, and be heard, and to present evidence in his/her behalf or otherwise answer the charges against him/her.
HOLDER
Shall mean a person to whom a taxicab license has been issued.
INDEPENDENT TAXICAB
Shall mean a taxicab that does not belong to a taxicab association as defined herein.
MANAGER
Shall mean the Manager, Office of Taxicabs.
OFFICE OF TAXICABS
Shall mean the Office of Taxicabs within the Department of Public Safety, Division of Police.
OPEN STAND
Shall mean a public place alongside the curb of a street or elsewhere in the City which has been designated by the Manager, Office of Taxicabs, as reserved exclusively for the use of taxicabs.
OPERATIONS
Shall mean conducting a taxi service in the City of Newark which shall include receiving passengers in the City of Newark and regularly discharging passengers in the City of Newark that originate in other jurisdictions.
OWNER-OPERATOR
Shall mean, in the case of an individual, the person to whom the taxicab license is issued and who drives the taxicab exclusively or in the case of a corporation, the person who holds a minimum of 75% of the voting shares or interest in the corporation and to whom a minimum of 75% of the net profit or loss is attributable.
RATE CARD
Shall mean a card, containing the rates of fare, issued by the Manager, Office of Taxicabs, for display in each taxicab.
STARTER
Shall mean and includes any person who shall be on duty at a taxicab stand; for the purpose of assisting in the loading or unloading of passengers from taxicabs; for receiving calls and dispatching taxicabs; and for soliciting passengers at such stand.
TAXICAB
Shall mean a motor vehicle, commonly called "taxi," which is:
a. 
Constructed so as to comfortably seat not less than four passengers exclusive of the driver; and
b. 
Engaged in the business of carrying passengers for hire; and
c. 
Held out, announced or advertised to operate on and over the public streets of the City; and
d. 
Accepts persons who may offer themselves for transportation from a place within the City; and
e. 
Not operated over a fixed route; and
f. 
Not more than 42 months of age according to the model year within the Vehicle Identification Number at the time it first becomes engaged in the taxicab business within the City of Newark and not more than 10 years of age to continue engagement and operation in the taxicab business within the City of Newark. Taxicabs shall be removed from service prior to the final inspection of each calendar year.
TAXICAB ASSOCIATION
Shall mean an association of at least 10 taxicabs having the following characteristics:
a. 
The same color or color scheme that is part of an accepted trademark;
b. 
Radio service;
c. 
Common garage.
TAXICAB COMMISSION
Shall mean the Taxicab Commission within the Department of Public Safety, Division of Police of the City of Newark.
TAXIMETER
Shall mean a mechanical instrument or device attached to a taxicab by which the charge for hire of a taxicab is mechanically calculated and on which such charge is plainly indicated.
TRANSFER
Shall mean to sell, transfer or in any other manner dispose of a taxicab license. Where the license is in the name of a corporation or other legal entity, any change in the majority ownership of the corporation or other legal entity shall constitute a transfer of the taxicab license held in the name of the corporation or other legal entity.
WAITING TIME
Shall mean the time when a taxicab is not in motion from the time of acceptance of a passenger or passengers to the time of discharge. Waiting time does not include any time during which the taxicab is not in motion, if due to any cause other than the request, act or fault of a passenger or passengers.
