There shall be a Department of Finance, the head of which shall be the Director of Finance. The Department, under the direction and supervision of the Director, shall be organized into the following five divisions:
a. 
Accounts and Control;
b. 
Treasury;
c. 
Revenue Collections;
d. 
Tax Abatement and Special Taxes;
e. 
Assessments.

The Director of Finance shall, prior to his/her appointment, be qualified by training or experience in government, finance and fiscal management. The Mayor may, with the consent of the Council, waive any of the requirements set forth above when, in their judgment, the best interests of the City shall be served thereby. Notwithstanding the above, effective January 1, 1991, such appointment shall satisfy the provisions of N.J.S. 40A:9-140.13. The Director's compensation shall be such sum annually as shall be fixed by ordinance.

a. 
The Director of Finance shall be the City's Chief Financial Officer. He/she shall be responsible for all financial activities and functions of the City Government other than those activities and functions for which responsibility is vested in the Business Administrator, the Tax Assessor or the Municipal Comptroller as provided in Section 2:7-9. He/she shall furnish a corporate surety bond, at the expense of the City, for the faithful performance of his/her duties, in such penal sum and in such form as shall be approved by resolution of the Council.
b. 
Through the divisions of the Department and otherwise, subject to ordinance, the Director of Finance shall be responsible for the accounting, pre-auditing and control of all City revenues and expenditures; for the custody, receipt and disbursement of City funds; for the safety and investment of the City's investments; for the management of the City's debt; for the development of financial policies for recommendation to the Mayor; and for the safeguarding of the City's financial interests to the fullest extent;
c. 
The Director of Finance shall be responsible for the collection and receipt of taxes, penalties and interest pursuant to law, and license and permit fees, except as otherwise provided in this chapter or other provisions of these Revised General Ordinances.

e. 
The Director of Finance shall be responsible for the collection, receipt and accounting of parking meter revenues.
f. 
The Director of Finance shall be responsible for all licenses authorized to be issued by the City pursuant to State law and local ordinance, except for such licenses the application and fee for which are required by State Statute to be received by a particular official or office other than this Division.
g. 
The Director of Finance shall:
1. 
Be responsible for the fiduciary covenants of the Pequannock Dedicated Trust (established May 7, 1986 7REA(AS); and
2. 
Require the Director of the Newark Watershed Conservation and Development Corporation to report semi-annually on the financial status of the Corporation; and
3. 
File a copy of the annual certified audit of the Corporation with the Finance Director and the City Clerk.

There shall be a Fiscal Advisory Board within the Department of Finance. The Board shall consist of nine citizens of broad experience and recognized knowledge of financial policy. The members of the Board shall be appointed by the Mayor to serve, without compensation, for a term of two years. The Board shall advise the appropriate officials of the Newark City Administration with respect to the planning, management and marketing of all City indebtedness. It shall have the right and power to request any pertinent data and/or have prepared for its use by the proper administration officers such material as it may deem necessary to properly formulate its recommendation to the appropriate officials. The Board shall have access to all accounts and books of record of the City of Newark, as they relate to financial policies and practices of fiscal management, at reasonable times.

There shall be within the Department of Finance the "Employees Retirement System of the City of Newark, New Jersey" as created and constituted pursuant to N.J.S. 43:13-22.3 et seq.
